The beginning of this case dates back to September 30th, when a package containing $3,000 was sent via mail from Rich mond, Va to Dunn, N. American Tobacco Company Wlos in Suit by the New Company. The suit that has been pending in the courts since Major W. A. Guthrie and others chartered the Blackwell Durham Tobacco Co. and asked that the American To bacco Comprny be restrained from using the name, has been decided by the supreme court in favor of the latter, and the case is consequently thrown out of court. This decision was given out by state supreme court Wednesday and the effect, so learned, of de barring the promoters of the new Blackwell Tobacco company from proceeding further in the litigation or the restraining or ders. This is the second time that this case has been before the su preme court of this state. The matter began in this way: The new law requiring foreign cor porations to domesticate was vio lated, so stated, by the Black well Durhsm Tobacco Company, branch of the American Tobacco company. There was organized a new company, the stock being owned by Messrs. 3. W. and George R. Blackwell and Messrs. W. A. and W. B. Guthrie. When the organization of the company was completed the secretary of state was asked for a charter for the Blackwell Durham Tobacco company, of Durham, the object being for the manufacture and sale of tobacco of all kinds and similar work. There not appear ing on the records of the state the name of any similar company the charter was issued. Immediately after getting the charter the new company began proceedings to compel the old company to quit the manufacture of tobacco under the chartered name of the new concern. In bringing this action, which was in the nature of a restraining or der, the names of the superin tendents and managers were linked with that of the company j sued, this evidently being for the purpose of preventing a removal from the state to the federal court. Then the fight began. The first hearing was before Judjre Fred Moore on the ques tion of removal from the state to the federal court, this motion be ing made by the representatives of the American Tobacco com pany. Judge Moore heard the argument and decided against removal. There was an appeal to the supreme court which upheld the tawer court. In the second round Judge Ferguson issued and order for the old Blackwell Durham To bacco company to produce in court its book., vouchers, etc., for the purpose of examination. and the order was served. The attorneys for the defendants made motion that this order be recalled, it being claimed that the court was going out of its bounds and jurisdiction. Judge Ferguson could not hear the mat ter on account of illnes and it was referred to Judge J. Craw ford Biggs. I le decide A that the order should not issue and it was recalled. Then there was an ap peal to the supreme court and this was the matter decided. The latest decision, to it is said by those who have looked into the matter, leaves absolutely nothing for the plaintigs to go upon. Fuller & Fuller for the d.ieiidants. PYTHIANS HAVE Blii TIME. Filtb District Meeting -Elaborate and Substantial Banqet. There was a large attendance at the annual meeting of the Knights of Pythias for the fifth district of the grand domain of North Carolina which was held in the castle hall of the East Durham lodge of Pythians Tues day night. After the regular business session of the meeting there was one of the best ban quets held in this section in re cent months. In the district there are eleven lodges and each of these had large representations present, the Durham, West Durham and East Durham lodges having very large delegations on hand for the busi ness meeting and for the banquet that followed. The meeting was called to or der by Mr. J. E. Pegram, dis trict deputy collector commander and the address of welcome was delivered by Mr. J. W. Cameron, of the East Durham lodge. This was respoded to by Mr. Pegram for the entire district and by others of the visitors. Then there was a roll called when it was shown that every lodge in the district was represented and had delegates present ready to report. These reports were then submitted at the secret meeting. After the reports there was an aedress by Mr. Thoma3, H. Webb, of Duke, grand vice chancellor, and by Mr. W. W. Wilson, of Raleigh, past grand chancellor. These addresses were followed by the conferring of the rank of esquire and then business for the good of the order. After the meeting came the banquet. This was an elaborate affair and was enjoyed by the large number who were present. Mr. J. E. Pegram, the district deputy, presided as toastmaster and there were a number of re sponses to toasts, amongthese be ing the following: "Again We Meet in Pythian Fidelity," Mr. Chas. U. Harris, of Center lodge No. 3, Raleigh. "Why We Want Our Friends to Ride the Goat," Mr. R. S. Mc Coin, of Henderson lodge No. 80. "History of Pythianism." Mr. J. D. Pridgen, of Durham lodge No. ,11. "The Value of Pythianism." Rev. M. C. Arrowooa, of Myrtle lodge No. Ill, Hillsboro. "Our New Born Babe," Mr. G. E. Moore, of Bynum lodge No. 1S1. "Friendship, the Greatest of Virtues," Rev. J. A. Dailey, of East Durham lodge No. 103. 'Pythianism and Benevolence, ' Mr. W. L. Lindsay, of Chapel Hill, lodge No. 37. In the banquet the menu was one that was substantial and it was greatly enjoyed. There was fruit salad, fried oysters, Sara toga chips, pickles, Haveners' bread turkey, cranberry sauce, rice, brown gravy, beaten bis cuits, sweet potatoes, chicken ?alad, tomatoes, caquet, wafers, cream, assorted cakes, coffee, cheese, crackers, crapes, bananas, apple?, cigars.
