Vc'rnng of Tdesday the 8ih of December, 1846, a
troposal was submitted, to make application to the
egi?lature ot North Carolina, at its present ses
sions, f.r such an alteration in the said charter as

floard, any wh :re within the territorial limits of
the Presbytery of Fayettcville. As this proposal
could not legally c acceded to without the con

THE SUPREME COURT.
The following is the bill which has been before
the Legislature,' in regard to the Supreme court.
But it will hardly beci.me a law at this session. It is
a Bill, "concerning the Supreme and Supeiior
Courts, and for the more speedy administration of
ustico tin rt in.
I . Be it enacted by the General Assembly of the
State of ftorth Carolina, and it is hereby enacted by
the authority of the same, That th! Supreme Court
shall hereafter consist of all the Judges, as well
those commissioned as Judges of the Supreme
Court, as thoee commissioned as Judges of the Su
perior Courts of Luw and Courts of Equity: and
that the said Judges, and their successors in office,
or any five of them, shall have power to hold the
said Court, with all and every jurisdiction, power,
privilege and authority, now by law possessed by
the siid Court, or the Judges thereof: That the
present Judges of the Superior Courts shall hereaf-ti-r
receive each a salary of two thousand two hun
dred and fifty doifars, to be paid quaiterly, in the
manner and on the days specified in the first sec
tion ot the Revised Statutes, entitled " Salaries and
Fees;" and all Judges hereafter appointed, shall
receive a like salary : That the first vacancy which
shall happen by death or otherwi.se, amongtt the
present Judges, shall not be filled, but Irom and
after such vacancy, the number of Judges shall be
reduced to nine.
Be it en.-cte l, That the State 3hall be divided
into nine Judicial Circuits.
3. Be it further enacted, That Ihe Superior Courts
of law and Courts of Enquity shall hereafter be
held by ail the Judges in manner following: The
Circu Ks sha 1 be classed as follows : the first, sec
ond, and third circuits shall form a first class; the
fourth, fifth, and sixth circuits shall form a second
class ; the s venth, eighth, and n-nth circuits shall
form a third class. At the first term of the Supreme
Court w hich shall be hidden under this Act, it shall
be th duty of the Jdg-s by an order of Court, lo
all.,1 time of their numter to each of the said class
es ; and the Judges so allotted to any class of cir
cuits, shall ride the circuits composing the same,
and hold the courts therein as may be arranged
between them, so that no Jude shall ride the same
circuit tw ice in succession. And so loiz as the
s id Supreme Co'irt shall consist of ten Judges, the
said"court shall make such order that the Judge not
allotted to any class of circuits, shall in turn ride
one or the other of the circuits, so that the exemp
tion from circuit duty, arising from there being
more Judges than circuits, may be afforded to each
Judge in due rotation.
4. Be it further enacted, That the Judges, from
and alter this act shall gc into operation, shall have

Supreme Court," and all laws inconsistent with this
Act, or for which this Act has made another pro
vision, and also all laws and clauses of laws, allow
ing to Judges extra compensation, for holding spe
cial terms of the Superior courts, shall be, and Ihe
same are hereby repealed. '
From the Raleigh S andard, 23d Dec.
For several days past the Senate has been
for the most part engaged in the discussion
of 8 Preamble and Resolution, introduced
by Mr Gilliam of Uerlie. The Preamble de
clares, among other thing", that ihe Mrxicau
War was brought on by " the action of the
Executive," and the Resolution appropriate
ten thousand dollar for the benefit of the
Regiment of Volunteers to be i sued iu this
Stat. On Saturdny last Mr Gilmer of Guil
ford, following iu the lead of Governor Gra
ham and that Tory newspaper, the Gieeus
borough Patriot, opened the discussion in a
violent aud unpatriotic speech iu favor of Ihe
Preamble; and on Monday able and conclu
sive arguments were delivered on the Ameri
can side of the question, by Dr Cameion of
Cumberland, and Gen. WiUon of Kdgecomb.
The Senate was also addie-sed on .Monday
by Messrs. Gilmer, Woodfiu, Ehriughuu,
aud Russell, in fa rot of the Preamble.
Iu the Senate, ou Saturday, Gen. Wilson
moved lo strike out that porliou of the Pream
ble which charges the Var ou the Executive;
on Monday, Gen. Hawkins of Warren, mov
ed to amend the motion by inserting that the
War had beeii brought tibout by the action of
JYlexico. The yeas and nays uot being
deuiauded; the Vote was taken by count, when
Mr Graves of Caswell, (temporarily iu the
Chair) aunouueed the result 21 yeas, 20 nays.
Whereupon the faces of the Federal members
lengthened considerably, and the yeas aud
nays were demauded ; aud the result was, 23
yeas, 24 nays. By hard t-ftrts ihey had
succeded iu whippiug iu three more of their
number, so as lo reach 24 ; and what did they
say by that vote? Why, that Mexico is not
in the wrong, aud that as a consequence,
our oxen country isl We leave the Federal
members of the Seuate to get out of this
predicament the best way they can.
Three cheers for Smithfielo. We
have just leceived ihe followitig letter from
Smilhfield, dated December 21, announcing
the arrival at that place of the Steamer John
ston. Our friend savs : "I hasten to in
form you that the Steamer Johnston hasjut
arrived here. She came up the River iu fine
style, thecanupu firing during the time. She
left Newbern on Saturday evening. There
is such a stir here lhat I cannot write auy
more. You can imagine the scene, and add

Alexander and Lafayette were laid on the

HOUSE OF COMMONS.
Mr Ellis, of Rowan, moved to reconsider
the vote taken on Saturday last, be which
the resolution to adjourn on Wednesday nest,
the 23d iust.y to Monday the 28th inst., wa
passed. He thought the House had no right
to pass such a resolution. Fie had found,
on teference to lb Constitution, that the
House could uot adjourn, only from d;iy to
day, except by joint resolution. Some ob
jection being made to reconsider the resolu
tion, he modified his motion by moving to
reconsider the vote taken ou the , resolution
offered by Mr - Putyear' of Surry, to rescind
the resolution offered by Mr Hall of New
Hanover.
Mr Washington of Craven, stated that he
wis decidedly of opinion lhat the House had
do Constitutional right to pass the resolution
on Saturday, and though it was therefore a
nullity, yet it ought not to Maud ou the Jour
nal, but ought to be rescinded that he also
concurred with the gentleman from Person
(Mr Holeman) that the inotiou of the gentle
ma u from Rowan (Mr Ellis) waY not ih or
der. The proper motion was that now made
to reconsider the vote by which the proposi
tion lo rescind was rejected on Saturday.
I bat motion was clearly in order.
The yeas aud nay being called for, the
question t reconsider the vole taken oh ihe
resolution lo rescind' the resolution passed to
adjourn, it was decided in the affirmative
yeas 103. nays 1'. The question was then
taken on the adoption f the resolution offered
by Mr Puryear, and decided in the affirma
tive yeas 104, naya 1.
Mr Griggs, of Currituck, offered the fol
lowing resolution which was adopted:
Resolved, That a Select Committee of

inquire into the condition, so far as is ascer
tained, of the Inlet which has been recently
