The Day Case. - The Supreme Court handed down its decision in the Day case Tuesday. Capt, V, H. Day is sustained in his contention -for control of the Pen : itentiary. Justice Montgomery de ; lirers the opinion of the court, sup- - plemented by a separate opinion by , Justice Furches which breathes partisan spirit. A dissenting opin ion is delivered by Justice Walter I Clark, which is very strong and forceful. He shows , up the otter " inconsistency of the court, in that the Justices deliving opinions hav on former occasions delivered opin ions directly antagonistic to their - opinions in this case. He sustains ' the fundamental power rested in the General Assembly to do and undo, with ability. 1 be outcome or tins decision is . far-reaching, it opens the flood eates for those disposed to sue for office, and may bring about no end " of trouble. Speaking of the decision the Morning Post says "It restores to Captain Day all the powers, rights and privileges conferred upon the superintendent by the act of 1897. It recognizes the Board of Directors, as increased by the recent act of the Assembly. It destroys the dual power confer red upon the Goremor and super intendent by the act of 1897, and ' simply makes the superintendent, or more particularly Captain Day, by virtue of his individual right to ' the office under the law, as now de cided, the executive officer: under supervision of the Board of Direc tors, as created by the last Legisla ' tore. - This is the sum and sub stance of the opinion of the court as rendered by Justice Montgomery." Justice Stephen J. Field, of the United States Supreme court, died at his residence in Washington Sun day evening. He was appointed to the Supreme court in 1803. and served continuously until bis retire ment Dec 1st, 1897, a period of more than 84 years. His period of service was longer than that of any one in the history of that great tri bunal, exceeding that 'of the cele brated chief ju tice John Marshall by a few months. Justice Field was born in Conn, on Nov. 4, 1816, and was one of four brothers, all of whom achieved world-wide fame. Judge Field, as a member af tbe Hayea-Tilden commission in 1877- '78, voted with the Democrats. '.
