AN ACT TO REQUIRE PHYSI CAL EXAMINATION BEFORE ISSUANCE OF LICENSE TO MARRY , The General Assembly of North i Carolina do enact: Section 1. No license to marry j shall be issued by the Register of 1 Deeds of any county to a male or ' female "ff>j>licant therefor except upon the Vfollowing conditions: The said applicant shall present to 1 the Registel of Deeds a certificate executed within seven days from the date of /presentation showing that, by the usual methods of ex amination made by a regularly li censed physician, no evidence of any venereal disease in the infec tious or communicable stage was found. Such certificate shall be 1 accompanied by the original re port from a laboratory approved; by the State Board of Health fori 1 making such tests showing that I the Wassermann or any other ap- ' proved test of this nature is nega- ' tive, such tests So have been made ^ within two weeks of the time ap- ' plication for license is made. 1 Furthermore, such certificate shall state that, by the usual me- ' thods of examination made by a 1 regularly licensed physician, no evidence of tuberculosis in the in fectious or communicable stage was found. And, furthermore, such certifi cate shall state that, by the usual methods of examination made by i a regularly licensed physician, thei applicant was found to be not' subject to 'epileptic attacks, an idiot, an imbecile, a mental defec-; tive, or of unsound mind. Sec. 2. Exceptions to the above \ section are permissible only under the condition hereinafter named: (a). When the medical history : ana pnysicai examination 01 enn-. er applicant shows syphilis to be, present, or when the laboratory 1 ' test for syphilis is positive, and provided both applicants are in- 1 formed that syphilitic infection is j present, certificate may be issued and, license granted only in the following instances: (1) When the1 \ applicant with syphilis has been under continuous weekly treat ment with udequaLe dosage of standard arsenical and bismuth preparation given by a regularly licensed physician for a neriod of "one year, and when .such applicant also signs an agreement to con tinue such treatment until cured or probated. It is specified that ' the condition stipulated in sub paragraph one above may be waived in instances in which the female applicant is pregnant and it is necessary to protect the le gitimacy of the offspring. In such j a case certificate may be granted j and license issued provided the applicant with syphilis signs an agreement to take adequate, ap proved treatment until cured or probated. (2). When the female applicant is past the childbearing ! age, and provided the applicant with syphilis signs an agreemeut to take adequate treatment until "Cured or probated. . Sec. 2l/t. Residents of the State* who are married outside of North Carolina, shall, within sixty days after they return to said State, file with the Register of Deeds of the County in which they live, a certificate showing that they have conformed to the requirements of the examination required by this | Act for those who are married in the Slate. Sec. 3. If either applicant has been adjudged by a court of ?com petent jurisdiction as beiug an idiot, imbecile, mental defective, subject to epi'.dptic attacks, or of unsound mind, license to marry shall be granted only after eugen ic sterilization has been perform ed on the applicant in accordance! with State laws governing eugenic J sterilization. Such certificate, upon the basis of which license to marry is gran- ! ted, shall be executed by any rep- i utable physician liceesed to prac tice in the State of North Carolina, whose duty it shall be to examine v| fiuch applicants and to issue cer tificate ih conformity with the re- ! quirements of this Act. Such certificate form shall be designed by the State Board of Health and shall be obtained by. the Register of Deeds from the State Board of Health upon re quest. That every examining physician ' under the provision of this law shall make and immediately file with the Department of Health of North Carolina a true copy of such certificate. Penalty for violation. Any vio lation of this Act, or any part thereof, by any person charged j herein with the responsibility of its enforcement shall be declared a misdemeanor and shall be^pun-l ishable by a fine of fifty dollars ^ ($50.00) or improsonment for' thirty days, or both. Sec. 4. Provided that this Act! ihall-not apply to applicants for narriage license by nonresidents ivho are residents of a State or| States which do not require the provisions of this law. Sec. 5. If any clause, sentence, paragraph, or part of this Act ihall for any reason be adjudged by any court of competent Juris diction to be invalid, such judg-j ment shall not affect, impair, or invalidate the remainder of this Act, but shall be confined in its; operation to the clause, sentence, j paragraph or part thereof direct- j ly involved in the controversy in ! which such judgment shall have been rendered. No caption of any sectiotf or set of sections shall in any way affect the interpretation of this Act or any part thereof. Sec. 6. That all laws and claus es of laws in Conflict with this Act are hereby repealed. Sec. 7. Th^t this Act shall be in full force and effect from and after its ratification. No word could better describe the condi tion of the crop in Vance and sur rounding counties than "Excel lent"; Season throughout the past week have been good, with a heavy rainfall on Thursday, which was accompanied with consider able hail. Damage was reported on young plants due to hail iu scattered sections, however, not enough was noted to effect con ditions over the territory as a whole. Taking the worst fields of to bacco rather than the best or the average, plants in these fields are only slightly smaller and not quite us fully and well developed; how ever, these plants most of which were recently transplanted, will grow out fully within the next J week, particularly after the re cent heavy rain. Warm days and nights have been perfect for grow ing plants and reports received from all sections are optimistic. Of course it is unreasonable to predict at this time how the crop will turn out, knowing of the variations of the many plights that may strike the crop before curing time, but if conditions re main normal with no serious hail or insect damage, the 1939 crop in this section will undoubtedly be one of the best on record, both from point of yield and quality of crop. Reports from the Border Belt state that a small number of planters will house their first to bacco during the next week.
