Denies Sales Tax

decision upholding the validity of
the North Carolina temergency
Revenue Act of 1937.

He brought suit in the Forsyth
County Courts to recover- $3. IS,
the amount of a 3 per cent sales
tax he paid under protest. Im
position of the tax was sustained.
Leonard contended the tax law
was unconstitutional.

ard, of Statesvllle, leader of the
North Carolina Fair Tax Associa
tion, against this levy.
Bach fiscal year since the tax
first was imposed as an emergen
cy measure in 1935 the North Car
olina Department of Revenue has
collected several millions of dol
lars. The rate is 3 per cent on
retail sales, with a relatively
small number of foodstuffs ex
empted by subsequent amend
ments.
In preparation for this suit,
Mr. Leonard established a small
retail business at Winston-Salem
and made a few sales, refusing to
collect the sales tax as is requir
?d by law. He then paid cha
small amount of tax due the Rev
enue Department under protest
and suit to collect the amount
was Instituted. In the course ;f
legal procedure, the North Caro
lina Supreme Court ruled against
Mr. Leonard, who thereafter eu
deavored to obtain review of the
case by the nation's highest covrrt
in tbehope of having the previous
decision set aside.

death o( this dear little boy, God's
precious gift to his parents. Ed

Dement, who remained to gladden
their lives just a bit over two
years, having been born Oct. 25. j
1937, while the ligbt of his life
went out on th? morning of Nov.
6. 1939, leaving loved ones in the'
t'loom of grief.
Just why this strange dispeiisa-,
tion of Providence no one can an
swer, we jusi know that lie doetii
all things well, and to His will >v,:
must bow. God needed another
angel and called "little Charlie":
to fill the place.
He was seized suddenly with an
uncommon malady, the dread dU
ease of lock-jaw, which the doctor
recognized in the onset and advis
ed hospital treatment. The baby
was taken to a hospital at Dur
ham, where the devoted pareu'si
and grandparents felt a cure
might be effected, but, all to no
avail, the skill of doctors and nur
ses. the fervent prayers of loved
ones proved fruitless, and iu the
early morning of Nov. 6, the baliy,
soul winged its flight back to the
God who gave It being, to be n
beacon light and a beckoning
hand to dear ones who are left.
An angel In heuven to make it a
sweeter, dearer place because ot
his being there. What a com
fort to know that loved ones can
go to him.
The grandparents, Mr. and Mrs.
Charlie Strother, and Mr. and Mrs.j
Charlie Dement seemed as though
they were giving up their child
so great was their grief at the g^>
ing of baby Charlie.
The funeral was held from the
home of Mr. Charlie Strother, bur
ial services and interment at Cor
inth church. Both were largely
attended. The flowers were espec
ially pretty. The flower girls were,
Helen Strother, Estelle Dement.

vices in a most fitting and Im
pressive manner, urging the loved
ones who had gotten the sweet
perfume from this little plant,
budded on earth, to be witness to
the full blown blossom with heav
enly fragrance. May God be with
