AN ACT TO RAISE TEN THOl'aAM) TIIOOPS.

if htreby enacted by the authority of the tamt,
That the Governor shall immediately after
the nisutirn nf t hit act. proceed to raise, by
.voluntary enlistment, a division or corps of
Jen inousaiti uen in serve uuniig m.
ent war, unless sooner discharged. The
troops of this corps shall be known as the
State troops of North Carolina.
k Sec. 2. Be it further enacted, That this di
vision shall consist of a corps of artillery and
engineers, one regiment of cavalry, and eight
regiment' of infantry, light infantry and ri
flemen, to be recruited under the general
direction of the Governor, and in conformi
ty with such regulations as he may prescribe.
Skc. 3. Be a further enacted. That the
corps of artillery and engineer shall consist
of not exceeding eight companies, or batte
ries of light and heavy artillery, with one
colonel, chief of artillery and engineer, one
lieutenant-colonel, two majors, (one quarter
master ami one commissary with the rank of
first lieutenant, and one adjutant, all to be
appointed by the colonel, the last from the
first lieutenants oi the corps,) one sergeant
major, one quartermaster's sergeant, ten cap
tains, sixteen first lieutenant and sixteen
econd lieutenants. Each company shall
consist of one first sergeant, one quartermas
ter sergeant, three sergeant, four corporal,
two buglers, two artificers (and in addition
for each light company, one farrier and one
blacksmith,) and ninety privates. Each com
pany to have one captain and four lieuten
ants, to be assigned bv the colonel nr other
commanding officer. The chief of the corps
shall detail such commissioned officers as
nay be necessary to perform the duties of
the engineer and ordinance department.
Officers so detailed are subject at ay time
to be relieved from such duties by the chief.
All officers of this corps shall be subject to
the same rules and regulations as to com
mand, which govern the officers of infantry
and cavalry : Provided, That officers special
ly detailed on engineer a wl ordnance duty
shall not assume or be ordered on any other
.duty while so detailed, except by order of
the commander-in-chief.
Sec. 4. Be it further enacted, Tnat the reg
iraent of cavalry shll consist of one colonel,
one lieutenant-colonel, two majors, (one
commissary and one quartermaster with the
rank of first lieutenant, and one adjutant with
the rank and command of first-lieutenant, all
of whom shall be appointed by the colonel;)
one sergeant major; one quartermaster ser
geant; one commissary sergeant; and ten

with the assimilated rank cf Colonel, six as
sistant adjutants and inspector central, to
rank as loilows: one lieutenant Colonel, one
major and four Captaim: eight assistant
quartermasters, and paymasters general to
rank as follows: one lieutemnt Colonel, two
major, and ve Captains : sii assistant com
mi'sgries general of suhitance, to rank a
fo.Iwas: one lieutenant Lclonel, one major
and four Captains; ten surgeons with the as

un assistant surgeons, with the assimilated

ment one chaplain, with the pay of major, and

tain. Sac. 6. Be it further tnifted. That the
Governor shall, by and with Ihe advice and
totsent of the military board, appoint the
commissioned officers provided for in ihis act
(except the anis-oe-camp.; Ihe company

Suo. 12. Be it further enacted, That the
quartermaster and paymaster general, the
commissary general and their assistants and
all other disbursing officers shall before en
tering upon their duty give bond with ap-
firoved security payable to the State, for the
aithful performance of their duties, in such
sum as the Governor may require.
Sec. 13. Be it further enacted. That eve
ry enlisted man shall receive a bounty of fif
teen dollars, payable when mustered into
service.
Sec. 14. Be it further enacted, That all
laws and parts of laws inconsistent with this
act are herebv repealed.'
Six. 15. Be it further enaeted. That this
act shall be in force from and alter its pas

Suction 1, Be it enacted by the General

treason shall consist only in levying war
against this State, or in adhering to it ene
mies, giving them aid ai,l comfort; or in es
tablishing, without t!i'" authority of the Gen
eral Assembly, any Government within its
limits separate trout the existing govern
menl ; or in holding or executing in such
usurped government any office, or professing
allegiance or fidelity thereto, or assisting the
execution of the la un-lcr color of author
ity from such usurped government ; and such
treason, if proved by the testimony of two wit
nesses to the same over act, or by confession
in open court, shall be punished'with death.
Sec. i. Be it further enacted. That, if any
free person, knowing of any such treason,
shall not, as soon as may be, gite information
thereof to the Governor of the State, or to
some conservator of the peace, such person
shall be punished bv fine and iiuiii-isuniuent
at the discretion ol the Court.
Sec. 3. Be it further enacted. That, if any
free person advise or conspire with a slave
to rebel or to make insurrection in this State,
or with any person to induce a slave to re
bel or make insurrertiou, sx.li person shall
upon conviction suffer death, whether such
rebellion or insurrection be mail or nut.
S:c. 4. Be it further enacted. That this
act shall be in force from and after its rati

of Missouri militia, encamped at ('amp Jack
son, on the western outskirts of the city,
surrendered unconditionally this afternoon,
on demand ol Capt. Lyon, commander of the
United States forces of thiscny. Capt. Ly
on marched on Camp Jackson with some 6,
000 volunteers, surrounded t, and planted
eight field pieces on the adjoining eminence.
The following letter was sent from Capt.
Lyon to Gen. Frost:

To General D. M. Frost: Sir Your com
mand is regarded as evidently hostile to
wards the Government of the United States.
It is tor the most part made up ol those Se
cessionists who have openly avowed their
hostility to the General Government and
have been plotting the seizure ol its proper
ty and the overthrow of its authority. You
are openly in communication with the so-
called Southern Conlederacy, which is al
moral wr with the United States; and you
are receiving at your camp from said Con
federacy under its flag, large supplies of ma
terial of war, most of which is known to be
the properly of the United States. These
extraordinary preparation plainly indicate
none other than the well known purpose of
the Governor of this State, under whose or
ders you are acting and whose purpose, re
cently communicated to the legislature, has
just been responded to by that body in the
most unparalleled legislation, having in di
rect view hostilities to the general govern
ment, and co-operating with their enemies.
In view of these considerations, and your
failure to disperse, in obedience to the proc
lamation of the President, and of the emi
nent necessity ol State policy and welfare,
and obligations imposed upon me bv instruc
tions from Washington, it is my duiy to de
mand, and I d i hereby deinaod, of you an
immediate surrender of your command with
no other conditions than lht all persons sur
rendering under this demand shall bo hu
