Ob an appeal from a lower court, the Ken tacky court of appeals, Jodge Hobercon pre siding, Has just rendered a decoion, in th ease of the Louisvill and Nashville rail road company vs. J. Collins, one of its em ployees, who, through toe carelessness 0 the engineer, lost one of his legs, whilst in the immediate execution of an order from that engineer which decision is of much interest to all railroads. The court held the following: 1. A railroad is responsible to one of its employees tor any damage sustained by the gross negligence 0! any other employee 0 the road. 2. A railroad is responsible to persons occupying the attitude of strangers, for 1 carnages sustained oy we ordinary negli cence of the agents of the road. 3. One who is employed to load railroad ties on a constriction train must be recard cd in law as a stranger to the road, and the road is liable to him lor damages sustained by the negligence of trie engineer. 4. The old English law relieving a rail road from all liability for injuries received py cue employees of the road, and repair iiig rmploees to take the risk of each oth er' grois negligence, is not the law in Kentucky, ' 5.
