As we were going to press with our last issue, when the Demo c r a tic execu ti ve com in ittee passed the resolution declining to order a primary election, we did not have time to say anything more than to merely announce the result. It is, of course, well understood that under the plan of organiza tion, this question of primary is left to the judgment of the execu tive committee, composed of one member for each voting precinct in the county, and this committee is to act as to it may seem best for the interests of the Demo cratic party. The petitions for the primary were filed with the chairman and he immediately called the committee together to pas's ujKin the matter- At the meeting here last Monday, there was a full attendance .of the com niittee, the only townships not being represented being Parkton and St. Pauls. The committee, after being called to order, read the petitions and stated that it would first like to hear from Democrats not members of the committee- Mr. L. R. Hamer, of Thomp sons No. 2, offered the following resolution which was seconded by Mr. J. S. Oliver, of White House township: Whereas, it is the opinion of the Democratic executive com mittee of Robeson county, that a primary for the nomination of county officers, under the plan of organization, be held at this time, for the, reason that not suf ficient time can be given for the consideration of the plan of pri mary elections and of candidates, and the making of a canvass of the county before the primary, and before the general election and for the -further reason that there is no law, by which the voting in a primary election can be regulated and safe guarded, resolved that the petition for a primary be not granted at this time. J. S. Oliver, Lt R. Hamer. The question being declared open for discussion the following prominent Democrats favored the adoption of the resolution and thereby urged that the pri mary be not adopted at this time: R. S. Bond, of Rowland L. R. Hamer.of Raynham; Sheriff G. B. McLeod, of Lumberton; and Col. N- A. McLean, of Luna berton. Those speaking against the resolution and in favor of the adoption of the primary were A. J- McKinnon, of Maxton, and G. C. Fisher, of Alfordsville. After this discussion several members of the committee dis cussed the matter and upon the vote being taken the resolution of Mr. Hamer was adopted by a vote of twelve to six. Thus the committee, by a vote of two- thirds majority, decided that it is not to the Jaestlnterests of the Democratic party at this time to adopt the primary. The Robe sonian, before the meeting of this committee, had expressed no opinion on the question, but after hearing trip argument for and against the primary, we do not hesitate to say that we think the decision of $he committee was a wine one, and that it is to thevbest interests of the Demo cratic party in Robeson county that the primary was not adopted this time- The reasons most strongly urged against the adop tion of the primary, among oth ers, were the following: Thnt it was too late to give Democratic voters time to fully consitler the matter and to give the candidates for the various offices time to canvass the county before the primary. That there is no law in force whereby the holding of the primary could be so regulated and safe guarded as to prevent fraudulent voting and unfair methods being resorted to- There was no way by which Republicans and those who did not intend to support the nomi nees could be p evented from voting in the primary. That the holding of the primary would create dissension and bitterness anionc the Democrats in the county and thereby make it ios sible for the Republicans to take ad vantage of this in the Novem ber election. It appeared upon the hearing that quite a large number of the persons who signed the petitions for the pri mary misunderstood the matter and that they would not have signed had they known that there was no law under which the pri mary could be held. Quite a number of the petitioners who were present asked that their names be taken from the petition and reports were received from others who stated that they would not have signed the peti tion except under misapprehen sion. The Democratic executive committee of the county, repre senting as it does all sections of the county, is supposed to be and is in fact, the chief party council, charged with the duty of acting in all matters coming before it. for the best interests of the party, and we are sure that in its actior in regard to the primary, there can be no cause to doubt that the best interests of the Democratic party in Rob eson county will be subserved. Under the Democratic plan of organization, if carried out in the different precinct meetings, there can be no question but that each candidate can have his strength registered in such way as that he will receive it in the county convention, and besides, it gives every Democratic voter in every township the right and privilege to attend the primary and take pirt in the election of delegates and the selection of candidates. If any voter fails to attend this primary then he should not com plain that lie had no voice in the nomination of various officers. If for any reason there is adisposi tion on tne part or anyone m a primary to suppress the will of any candidate or democratic vo ter, the matter can be taken be fore the county convention and there presented, ad there is no doubt that the convention will see to it that each and every candidate shall have his strength, as provided under the democra tic plain of organization. This is pure democracy and no good Democrat can complain at the enforcement of these doctrines. Seaboard Excepts to Ruling. We copy the following in re- ierence to the action of the sea board Air Line railway, in an nealing from the order of the corporation commission, requir iug them to erect a union station at Lumberton. The full text of the exception is as follows: "Citizens of Lumberton vs "Seabord Air Line Railway et al. "The respondent, the Seaboard Air Lino railway excepts to the ruling and order made in the above entitled proceedings and cause on the 28th day of Julj -l'.HK), and states for its ground for exception as follows: "(1). That the North Carolina Corporation Commission is with out jurisdiction and authority to entertain said proceeding and make said rulings and order. "(2). That said rulings and order are in violation of the fifth amendment of the Constitution of the United States, in that the re sident is deprived of its prop erty without just compensation. "(J!). That said rulings and or der are in violation of the provis ions of the fourteenth amend ment of the Constitution of the United States, in that it deprives this res)ondent of its property without due process of laws and without compensation, and denies to this respondent the equal pro tection of the law, - "(4). MCALLISTER, Cashier. said provisions of the Constitu tion of the United States in that they compel t he respondent to enter into a contract with anoth railroad company and thereby they invade the Inviolable right of contract. "(5). For that the said order is unreasonable and arbitrary and unjust. "(6). For that the said order is confiscatory of the property of the defendant. "John D. Shaw 'Attorney for Seaboard A. Line." It will be seen from the above that the Seaboard Air Line rail way is trying to take advantage of the technicalities of the law in order to delay the erection of the depot, which is so much needed in Lumberton. lt seems to us that the railroad company cannot hope to finally get out of building this depot, but this move is only for the purpose of delaying the matter, harrassing the people of Lumberton and causing them to incur cost, with a view to coerc ing them into accepting some make shift. The evidence before the corporation commission showed conclusively that the freight receipts of the Seaboard Air Line railway were over $171,- 000 per year, besides over $13,- 000 for passenger receipts, lhis, of course, included the receipts from the freight exchange with the Raleigh and Charleston Rail road Co. at Lumberton. As this comes as a part of the revenue the town is clearly entitled to credit for it in the volume of busi ness shown. The people ot Lum berton have been very patient and long suffering in bearing the unfair treatment which they have received at the hands of the Seaboard Air Line. They have al lowed various claims for penalties to go unnoticed, and have always accorded the railroad company fair treatment in addition to the great amount of business they have given it. It seems that the railroad company intends to pur sue in the future the very narrow and selfish policy it has pursued in the past in reference to its treatment of the people of Lum berton. If this is to continue we think our people would be justified in resorting to their legal rights against the railroad, company in every particular. Our merchants can, if they will, bring numerous suits against the Seaboard Air Line Railroad Com pany for penalties for making over-charges for freight, for de lays in shipments, and for failure to pay over-charge claims, and for failure to furnish cars for shipments, and it "seems that they will be obliged to resort to a policy of retaliation in order to secure any sort of treatment at the hand of the railroad company. The Seaboard Air Line railway has, for many years, enjoyed a monopoly of the business at Lum berton, and it has appeared to have discouraged the building up of the town instead of encouraged it. Unde r these circumstances we think the people of this town as they are now able to do so, should encourage the building of a railroad to some competing line, preferable the AtlanticCoast Line railroad, and this can be done with very little effort. It would be the greatest thing that has ever occured, for the up buidingof Lumberton and for securing for the people of this town and community fair treat ment at the hands of the trans mutation companies. The At lantic Coast Line railroad is much more considerate of the town along its line with much less bus iness than Lumberton. It has recently erected elegant press brick station at Dillon, S. C, Marion, S. C, at Vineland, N. C, Wilson, N. C, Rocky Mount, N. C, and quite a number of other places. We have often said that the railroadswere largely respon sible for creating the prejudice which exists against them among the people along their lines and the treatment that the Seaboard Air Line has accorded to Lum berton,certainly tends to bear out our contention.
