THE LATEST SHAME. a mue less man a month ago during the night of July 13th four members of a hard work ing honest farmer's family, in cluding himself, were fell upon while they slept in their borne in Rowan county and murdered. It was one of the blackest crimes ever committed in the State and the heart of every one sickened at its horribleness. The details were. read, rehearsed and discuss ed from one end of the State to the other. There was nothing but sympathy for the victims and their dead ones and the perpe trators were denounced. There was sufficient circumstatial evi dence to accuse several negroes with the commission of the crime. They were arrested and taken to Mecklenburg county jail for safe keeping or to avoid any attempt that might be made to lynch them. The Governor ordered a special term of Rowan cou rt to try them. This court con vened in Salisbury a week ago to day, the earliest time it could be convened under our laws. Judge Long was assigned to try the case and extra counsel were re tained to help prosecute them. There was nothing in the pro ceedings of the court the first day that would indicate that jus tice would miscarry. Further evidence had been secured since the crime was committed to in sure the conviction of part of them at least and probably all. But Tuesday morning the out side world was informed that three of them had been taken fro.n the jail and lynched by a mob and their bodies were riddled with bullets- We do not believe that any punishmentis too severe forthose who are guilty of committing a crime as black hs the murderers of the Lyerly family committed but a mob is not the right party to administer the punishment. We have no sympathy for the murderers. They deserve none but we have laws to administer punishment for crime and this is the proper channel through which" to administer it. If there are cases when justice miscarries and the rights of citizens are trampled on, this was not one of them. The court was proceed ing as rapidly as possible to do its duty and if it had had proper time and then failed it would have been different, though mob violence would not have been justifiable. We have come to an awful state of affairs when blood thirsty people take tbe law into their hands and go to killing peo ple and the end is not yet. Every time that a mob is successful and its members go unpunished it is tncouragment to the practice and less provocation will cause its re petition. NEEDED LEGISLATION. There Is one -thing which -we trust the next- Legislature will do as soon after it meets as pos sible and that is to enact a law giving to the corporation com mission of Worth Carolina mere Kwer. touching the regulation 01 railroads. One power which we think ought to be conferred upon tho corporation commission is fie power to require railroads to maintain their track and road bed in such condition as to make it safe for the transportation of passengers. There are quite a number of roads in North Caro lina which, on account of negli gence, are in such condition that it is absolutely unsafe to operate passenger trains over them. A number of these roads have rot ten ties. In our opinion tho most notable instance of an unsafe road bed is that from Charlotte to Wilmington, and particularly that part from' Hamlet to Wil mington. Some day the people will awake to the importance of this suggestion and unfortunate ly the cause of the awakening SJ may be a terrible wreck in which OH I'... ... ,t Ya lot 'PVin uiaiijr uvea uiaj irc mou. uv Seaboard Air Line is certainly obtaining sufficient business and revenue from the road from be tween Wilmington and Charlotte to justify them in improving the road bed, but the question of revenue ought not to be the con sideration. If a railroad company is unable to properly maintain its road bed so as to make it safe for the transportation of passen sengers and freight, then they ought not to be allowed to operate the road at all. UNFAIRNESS IN CHALLENGES. Judge Neal is in favor ol some changes in our laws. He says "Under the law as it now exists in this State, when a person is charted with the commission of a capital, criminal offense and is placed'on trial he may challenge preemptorily twenty three jurors and the State challenge only four. From an exj erience in t he prac tice of law and then five years' work on the bench, it is clear to my mind that the statute ought to be changed so that in the trial of the offenses of arson, raie, murder and burglary, the four capital felonies, the State ought to have the same number of chal lenges as the prisoner- It is my deliberate opinion that this will help solve the lynching problem." There are lots of people think the same way about it and tho number is increasing. It is time thatsomething be done. We are for giving a man on trial for his life every reasonable advantage, but if a law is just there should be a reasonable chance to make its enforcement possible. We hardly ever talk shop but occasionally the notion strikes us. This is one of those times. We are sure there are lots of peo ple in the county who ought to be taking the Robesonian and we nereoy invite you to do so There is nothing selfish in this desire of ours. We simply be lieve that you ought to take the paper and that you will continue to take it after you have once started,, There is no better way to spend a 1.50 than for a year's subscription to the paper. The Cowardice of Mobs. Statesville Landmark. The Monroe Journal adverts to the cowardice of mobs, -who always wreak vengeance on friendless and unprotected crimi nals, but who are mighty careful to keep their hands off criminals of prominence and influence. The Landmark has called attention to this feature of mob law and it cannot be mentioned too often. The truth is in the majority of cases the majority of a lynching party is made up of men who are not brave individually Often many are personally cowards. Hut feeling secure in a crowd and. nerved by liquor they will help to murder a wretch some of them would not face in the open as individuals, man to man. In his charge to the grand jury of Iredell superior court last week Judge Ferguson illustrated this I feature of mob cowardice forci bly. If one really and truly be- j neves mat a prisoner should be killed without waiting for trial, said his honor in substance, he should go alone to the jail, where anindividual who professes peace ful inclinations can generally gain ready access, and having gained the presence of the prisoner he should draw his weapon and kill him .on the spot. But that takes courage, for the perpetratoTTof such a deed would almost surely lace a charge of murder, with the chances against him. Instead of showing courage as an indivi dual the advocate of lynch law -seeks security in numbers, under the shades of night, to perpet to a deed that he lacks the cour age to assume the responsibility for as an individual This feature of mob cowardice and the other feature which selects only ne.. groes and white men who are supposed to have little influence, as victims while men of wealth and prominence escape, just as they too often do in the court, makes the average mob an obiect of contempt in the eyes of brave, reflecting and . . right thinking men.
