Freeman Printing Farther Report of County Board of Audit and Finance Replied to by Board of Commissioners of Cuunty. ro The Public: It is with regret that we have to again ask the indulgence of the public for the purpose of correcting certain statements contained in the "further report of the board of audit and finance" which was filed on February 29th, 1908. We have no desire to re hash any of the matters refer red to in the original report of the board of audit and finance, or in the reply of Sheriff McLeod and the board of commissioners thereto, as we think the public are in posession of all ef the facts and fully understand the matters embraced therein. There are certain things, however, which are contained in this "further re port" of the board of audit and finance which were not touched upon in their original report. and inasmuch as our board is again unjustly nriticised and the facts incorrectly stated, we fee that it is due to our board and to the public at large that these things be set straight in the minds of the public. The board of commissioners is criticised by the board of audit and finance for their action i borrowing from the county treasurer the sum of $5,000 from the funds in his hands de rived from the special taxes lev ied for the purpose of building the new court house, and the board also expresses the opinion that both the treasurer and our board violated the law when this was done. They also state that this money was borrowed to de fray the ordinary expenses of the county and that the sum bor rowed did not bear interest until maturity. These statements a, e incorrect. Not a penny of the money borrowed was applied to ward defraying the general ex penses of the county and every dollar drew interest from the date it was borrowed at-6 per cent. The facts are these: It will be remembered that after the act authorizing the bond is sue was passed and after the contract for the erection of the new court house bad been let and the work started, a question arose as to the validity of the act under which the bonds were is sued and the purchasers of the bonds declined to comply with the terms of their bid for same. Thereupon it became necessary to submit the question to the courts ana trie commissioners caused proceedings tobeinstitui ed for the purpose of testing the validity of the bonds. In the meantime, pending a decision from the supreme court, we were compelled to make some ar rangements to secure the money wherewith to proceed with the work of building the new court house. We could not afford to allow the work to stop, for this would not only have been incon venient, but wo would also have subjected the county to an action for damages on the part of the contractor. We found that the county treasurer had not completed the investment of the sinking fund in his hands and that he had on hand $5,000 which could be used for this purpose. Therefore, on Decem ber 16th, 1907, our board bor rowed $2,000 for the purpose of paying for work done up to that time on the court house, and en February 3rd. 1908, borrowed an additional $3,000 for a like pur pose, for which the notes of the county were executed and turn ed over to the county treasurer. The loan was only for temporary purposes and w?s to be repaid as soon as the proceeds from the sale of bonds was in hand. Ti. or three weeks ago the supreme court handed down an opinion upholding the validity of the bonds and after some delay the purchasers complied with the terms of their bid aud the bonds were issued. The proceeds of the bonds were only received last week and an order was made at the last meeting of our board for the taking up of these uotes. Every dollar was repaid to the sinkiug fund, together with in terest from the date of the re spective Iort.ss, at the first meet-! whereas it was read to Col. The reason one of the notes was made fr six mouths is, the company contracting for the fo: the attorney for the board had no right whatever to sub mit the same to any individual before it was filed as the law di rects. It was an official docu ment, in his hands for the pur pose of being filed, and we do not see that it was any part of his duty to be showing it to any one before filed as the law di rects. It will not do for the board of audit and finance to play the part of Roosevelt and say the statement is "absolutely and un qualifiedly untrue," for the evi dence is overwhelming that it was shown to Col. Edmund as charged by us. And if the boari of audit and finance wishes tht evidence and will call a meeting of its board for the purpose and subpoena the persons we name, we will produce the evidence or make apologies for making the charge. We note again that in their further report" that they di rected their atttorney to trans mit to the solicitor a copy of their report. The truth of the matter is, the chairman of the boaod of audit and finance was seen to call the solicitor in the wash room in the Waverly Hotel, during the February term ol court and give to him a copy ol the report. This was after oar reply had been printed and mouths after the the report had been submitted to Col. Edmund, according to their own statement- Board of Commissioners of Robeson county, by J. W. Carter, Chairman. Maxton, N. C, March 11, 1908 have been read to Mr. A. E White and other favored indi viduals before publication, but if this be true it only makes the vi- bond had repudiated their con ko!ation of the law the greater, tract and tha validity of the bonds was being tested in the courts The bond company had, accord ing to advice furnished us, for feited one thousand dollars plac ed with us as a guarantee of good faith in fbeir bid- Messrs. McLean McLean, attorneys for the purchasers of these bonds, made demand or. us for this money, and stated that they would have to bring suit for the same ia case we did not return it. We refused to surrender it and it seemed to us as if the matter wuld be further tied up in the courts and that we would be campelled to advertise the bonds for sale again, wLich we did. Hence it seemed wise to borrow this money for a longer period than it became necessary to use it. As stated above, every dol lar of this money has been re paid to the sinking fund with in terest from the time the loan was made. We think the people will ap prove our action in the premises Manifestly it was for the benefit of the public at large and the on ly practical thing to do under the circumstances. Theonly re quirement, of law as to the mak ing of loans of the funds belong ing to the sinking fund is that the loans must be safe and must bear interest. We were advised by competeiit counsel before taking any action that it was perfectly legal for us to borrow money from the sink ing fund, provided a proper note was executed therefor and pro Tided interest was paid. This was done. We are responsible for our action in this matter, both to the courts and to our people. All the foregoing facts could easily have been ascertained by application to any member of o ir board, to our attorney, to the reg ister of deeds or anyone else fa miliar with the facts. Indeed, the records of the board and of the treasurer show these facts themselves. We note also that toe board of audit and finance says that "the statement made by the commis sioners that our report was shown to Mr. S. A- Edmund sev eral days before it was made public, or anyone else allowed to set it, is absolutely and un qualified untrue." We have o desire to go into this matter again, but as it seems our veracity is questioned it becomes necessary to state the facts in our possession as can be shown by abundant evi dence. The report was not filed with the register of deeds as provided by law until Tuesday, December 24th, 1907. It can be shown by abundant evidence (indeed, we do not think it will be i denied by the party himsell) that the report was read by Col. S. A. Edmund just as stated in our original reply, behind closed doors, at night, Beveral days be fore it wis made public and filed as required by law. It can be shown by such evidence that it was read to him by the attorney lor the board of audit and finance on Friday night, December 20th We are also advised, so far as its being filed for publication with The Robesonian is concerned, that there is no provision of law providing lor its being filed with The Robesoaian, and that even if it were given to the editor before being made public that this, in itself, was a violation of law upon the part of the board of audit and finance. But however that may be, we understand that the report was not given to the editor of The Robesonian until Satur day night, December 2lst, PISTOL BATTLE IN DARK ROOM. Three lien Shot. Two Probably! Charles Nichols and Joe Mc Clutcha were arrested. The wounded: Mace McClut cha and Thomas Nichols, fatal ly wounded. William McClutcha, slightly wounded. At a country dance near Kiowa last night an alteraction occurred between members t f the McClutcha and Nichols families. After the dance Charles Nichols went home ac companied by a friend. Some time after retiring Nichols and his friend were aroused bv some one entering the house. They seized theirguns and be gan firing, the shots being re turned. Thomas Nichols, fath er of the young man, rushed iuto the room armed and tht shooting became general. Bessie, Charles Nichols' sis ter, spang between twoof them. Demented Woman Snoots Friend and Suicides. Boston Dispatch. 11th. i Suffering from melancholia, due to overwork, Miss Sarah Chamberlain Weed, of Philadel phia, shot and killed Miss Eliza beth Bailej Hardee, of East Sa vannah, Ga , and then committed suicide at the Laurens School for Girls in the Penwaj district to day. The bodies of the two women were found in bedto-day by Mrs. Page, the matron of the school. The Laurens School was estab lished last fall by Miss Hardee and Miss Weed. On October 1st, the day the school opened, Miss Weed broke down as a result of overwork, and was committed to a sanitarium in order to be treated for nervous prostration. Last night Miss Weed escaped from the sanitarium and made her way to the school. She ap peared to be badly deranged mentally. A fruitless attempt was: made to commanicate with the authorities of the sanitarium, and at length Miss Hardee suc ceeded in getting Miss Weed to go to bed in Miss Hardee's chamber on the third floor in the school building. Miss Hardte retired with Miss Weed Both women were awakened I by Mrs. Page about 6 a. m. and notified that they must get up if thoy were to catch the 7:35 train on which Miss Weed was to be taken back to West Newton. Mrs. Page then left them, and a few moments later the shooting occurred. Mrs. Page thinks the mention of returning to the san itarium must have excited and angered Miss Weed and induced the shooting.
