MR. JUSTICE PECKHAM.
An Associate Justice Of The
United States Supreme Court
Passes Away.
Rufus W. Peckham, associate
justice of the United States
Supreme Court, died Sunday
night at Coolmore, his summer
home at Altamont, Albany coun
ty, N. Y. Death was due to a
complication of diseases. He
had been in ill health for some
time but his condition was not
considered serious until recently.
JusticePeckham was a Demo
crat, and before taking a seat on
the bench, gave considerable
attention to politics inNewYork.
He was born in Alabany, N. Y.
November 8. 1838, and had
been on the bench, State and
Federal, for 26 years. He came
from the court of appeals of his
native State, a position which

to that position in 1868. He after
wards became in succession cor
poration counsel for the city of
Albany, member of the Supreme
Court of the State and associate
justice of the State court of ap
peals. He was the last of Presi
dent Cleveland's Democratic
appointees to the Federal Su
preme Court, Chief Justice Ful
ler and Justice White being the
other two. He took his seat in
January, 1896.
There is no rule to govern the
appointment of a successor to
Justice Peckham,butit is thought
that the vacancy on the bench
will by precedent likely go to a
Democrat. No action in the
matter will be taken until af
ter President Taf t s return to
Washington from his tour
through the country.

an advantage and helping to keep
up the price of cotton, while at
the sariie time he will be helping

always helped them. That has
nothing to do with the matter if
it is to the farmer's interest to
buy liberally of cotton goods
now, and in the present instance
that appears to be so. The mill
people deny that they are trying
to depress the price of cotton:
they maintain that they want
the price maintained but at the
same time must sell their goods
and get enough for them to
meet the prices of cotton if
they are to continue in business.
