The Charlotte Democrat is opposed to
building a new Court IIomm thinks the
old one can be made to answer all the pur

grant to the county the old U. B. Mint

The Proposed Constitutional
THE AMENDMENTS PROPOSED TO
ARTICLE IV JUDICIAL DEPART
able to define the Jurisdiction of the several
Courts! then a Convention. Being immediately
elected by and directly responsible to the peo
ple, it will be sufficiently intelligent to form an
an impartial judgment concerning the real ne
cessities and wi-hes of the people. It will be
impossible for the Legislature to create greater
confusion in the matter of the Jurisdiction and
procedure of the several Courts than already
exists. Thia "confusion" dates from the com
mencement of Radical rule in .this State. It
was unknown to our old Constitution and
law.. And as far as the lawyer are concern
ed, their best friends are in the Radical, not
in the Conservative rank?, as the Legislation
of the past .even years abundantly proves.
(b). The Legislature will itself elect
the Judges and clerks of all snch Courts as
may be eHtablished by law, and will elect them
for the full term of the eight years.
Ans. Until the Legislature shall create
other Courts, define their powers and Jurisdic
tion, and prescribe in what manner and for
what terms the presiding officers and clerks of
said Courts shall be elected, it is impossible to
speculate with much certainty about the matter
It is not probable, that the Legislature will
abuse tbia great trust, placed in its hands by
the people themselves for their own benefit and
protection. The Legislature possessed still
greater authority under the old Constitution ;
and even under the present, it has greater pow
er, in regard to the creation of "Special Courts"
for the Judges and clerks of such Courts may
now be elected by the Legislature or life, and
these "Special Courts" may be multiplied to
an indefinite extent. But if the amendments
shall obtain the sanction of the people, this
power of the Legislature to establish "Special
Courts" will cease.
