K The Utter Withheld Temporarily," ; The Federal court which was in session in Charlotte last week, and presided over by Judge Boyd, dis posed of a long standing case against D. L. Arey, of this city. The judgment of the court, after being found guilty, was as fol lows: s ''He said'hte regretted his in ability to grant the request of tjomisel for tide defendant to im pose n reasonable fine without imprisonment. The testimony of the physcians as to the health of Mr. Arey, he said, caused him to hesitate before imposing a sen tence that would carry with it a term- in prisonand yet there was stern, justice to be considered. After a prolonged pause Judge Boyd announced that he would give the defendant his choice of two alternatives. He could ac cept the maximum punishment prescribed under the first count in bill of indictment, of carrying on the business of a rectifier with intent to defraud the government, and serve a term of two years im prisonment and pay; a fine of $5,000 and the costs, or take the minimum punishment under the tenth count that of removing and concealing spirits, pay $24,000 of taxes defrauded from the gov ernment, serve a term of three months imprisonment and pay a fine of $200 and costs." Later in the day (last Wednes day) as reported by the Charlotte Observer, the following disposi tion was made of the. case: "A little after 5 o'clock the de fendant, with his counsel, accom panied by District Attorney Hol ton and Assistant District Attor ney Price, filed into the court room and stated to his honor, Judge Boyd, that a disposition of the case was at hand, if such action .was satisfactory to the court. Dis trict Attorney Holton filed a com plaint dealing with the issues at stake and R. H. McNeil, for the defense, submitted an answer. In the answer, Mr. McNeill admitted that Mr. Arey was due the govern ment $22,000 for spirits rectified on which no tax had been paid. This being satisfactory to the prosecution, a judgment was sign ed requiring Mr. Arey to pay this sum. He turned over $5,000 at once arkl the remainder will be paid at a reasonable time.
