Prosecution Working on a Clue Which May Aid in Establishing a Conspiracy. After a strenuous reoess day on the part of counsel on both .sides in the Cooper-Sharp trial for the murder of former United States Senator Edward W. Carnrack, only two facta developed. Ont was that S. J. Bennings, the mysteri ous witness tor the defense who claimed he saw Senator Garmack revolving the cylinder of a gun, which will not revolve, will be re called for further cross-examination by the State. The other was the feverish activity of the special agents or escret police of the prose cution. It developed that this ac tivity was due to Attorney General McCarn's belief that he had dis covered a clue to the identity of one of the three mysterious men who, would make valuable witness es for the prosecution. On the day of Carmack's death early in the day, three men visit ed the office of The Nashville Tennessean of which Senator Car mack was editor. Each of the men. asked at the business office if the clerk could give him Mr. Car- mack's address and if he knew a bout what time the Senator went home each afternoon. Two of the men called in the morning or be fore noon. The clerks in the counting room did not know where Mr. Carmack lived. But after the second inquiry they secured the information and when the third man appeared after 1 p they gave him the address. m. "Our clue is very vague," said Attorney General McCarn tonight, "aurl I doubt if we will be able to use the information. We know that the inquires were made and can prove tnis Dy Tennessean em ployes. But unless we can identify the men who made them and then further connect them directly with a conspiracy to murder Senator Carmack under our laws we could not offer the testimony- even of The Tennessean employes. We are sparing no pains to identify the men, however, despite the ap parent hopelessness of the task. Of cdurse even if we identify the men they will deny the charge and we might not be able to connect them with the defendants." Counsel for defense were not less active. Old and new witnesses vis ited their office all day anda num ber of new subpoenas was issued on their behalf. It became generally knawn to day that counsel for the prosecu tion would not cross-examine either Governor M. R, Patterson or Adjutant General Tttlley Brown. At the same time it became just as well known that the attorneys for the State disagreed as to the wisdom of this proceeding. At least two of the attorneys for the prosecution are strong political enemies of the Chief Executive . These favored grilling the Gover nor, The other, however, object ed for two reasons. First, they considered that the Governor's testimony simply corrodorated that of other witnesses as to- the famous conferences the day of the tragedy. These conferences the State admits took place . Second ly, of the 12 jurors, nine are Pat terson supporters and it was not deemed advisable to attack the Governor on this account. The man who really, it is said, came from the country, was later arrested. An unprecedented scandal of liquor drinking and cigaretto smoking on part of boys- and girls in the high school brought to a head Tuesday by expulsion of a girl member of th juuior class. Other expulsions are expected to occur. The ex pulusion of a girl came as a result of an . investigation iuto,charejes of misbehavior on the part of boy and girl students by the school Oimmittee. At a reception and dance given ior miss xie'ene Kooinson, a new teacher in the high school audi torium, on last Friday Dight, it is alleged that whiskey was brought into the school by one of the boy students, and that four girls and some of the boys went into the basement, where they drank the If' TT 1 - contents of the bottle andsmoked cigarets. On returniDg to the hall, it is alleged that one of the girls was so intoxicated that she could hardly -walk, and that the others showed evidence of thejr carousal. This is the second scandal of this kind that has developed within three weeks.
