WOMAN JAILED
2 YEARS FINDS
TERM ILLEGAL
Ann Arbor, Mich.—Betty Keith,
27, one of scores of persons who have
served or are serving illegal prison
terms, is free again.
After two years in the house of cor
rection, convicted under a law no
longer existing and sentenced on a
statute that has been repealed, Betty
is free to do as she pleases.
Circuit Judge George W. Sample,
of Ann Arbor, who sentenced Betty
two years ago, nolle prossed the charge
against her after a new trial Viad fofcen
granted.
Mrs. Alean B. Clutts, Betty’s at
torney, showed the law under which
Betty was arrested had been repealed
nearly a year before her arrest. There
was no law under which she could be
sent to jail. Nevertheless, she was sen
tenced to serve from one to four years,
with a recommendation of four. She
was convicted of possessing narcotics.
"Betty is not the only person who
has served an illegal term for such an
offense,” Mrs. Clutts said. "I have ob
tained releases for several. The last
time I visited Jackson prison I was
told there were 16 men serving terms
under this law, which had been re
pealed before their conviction.
"The attorney general could, if he
desired, examine the cases of prison
ers now in jail. He could discover these
injustices and could order the men re
leased. As it is, men and women are in
jail illegally, with no prospect of re
lease unless they can find funds with
which to engage an attorney.” ;
DOG HIS LEGACY
IN SUICIDE NOTE
Chicago—So discouraged by chron
ic illness that he cared to live no long
er, Floyd oung, 45, wanted to do a
lost kindness for his daughter, Betty
Devorcheck.
There was little he could leave her,
but:
"Please yke 'Snuggle’ home and
keep her for Betty, as I want her to
have her. She has been awful good to
me.”
Such was the message found near
Young’s body in his basement flat at
3639 Sheffield Ave. Addressed to
George Schell, fellow janitor, living
at 3610 Rokeby St., it listed persons
owing Young a total of $205 for odd
jobs, and spoke of $300 insurance,
concluding:
"Please forgive me, but I am sick
so much it is better so.”
"Snuggle” was found there, sitting,
wondering-eyed near the smoking stand
on which stood a bottle that, had con
tained poison.
