To President’s Program
While Codes Are Voluntary Agree
ments, Review Of Situation

The blanket code is a practical
plan that is bringing immediate,
practical results that were impos
sible under the original code pro
gram of President Roosevelt.
This is the view of some editors,
economists and many business men
now engaged in measuring progress
under the code. Although President
Roosevelt and General Johnson in
sist that the blanket code is en
tirely a voluntary agreement, the
Business Week Magazine points out
in a survey of the entire methods
being pursued in putting the code
into operation that it is going to
be very hard for any industries to
sav "no” to the President’s pro
gram. In reality the President will
have public opinion on his side.
Prices went up too fast and in
dustries came across too slowly.
That is the whole storv back of the
socalled "blanket code,” which
really isn’t a code at all but a vol
untary agreement. There’s a diff
erence.
Whether industries came across
so slowly because prices went up so
fast or because the speed required
to make the original NRA plan
effective in time was wholly im
practical, does not matter now.
The original plan has been supple
mented by the "President’s Re
employment Program” ^ which
makes possible the immediate and
stimultaneous enlistment of all in
dustries and furnishes thoroughly
practical reasons for it. Most prac
tical: the full weight of public
censure if going to be turned on
those that don’t enlist.
This Second phase of recovery
dbes not end the first. While pass
ing out "Blue Hawks” to business
men who get under the blanket
the NRA will keep right on hear
ing individual industries and pro
mulgating separate codes for them.
Part of the reason for designing
jthe new ready-made code for busi
ness was that it will hurry in appli
cations for the individually tailored
regulations still available.
A third phase of recovery tics
ahead. For all trades or industries
which have not submitted codles
. . . by September 1, the President
will begin to hold hearings under
Sec. 3 (d) as fast as proper notice
can be given and hearings arrang
ed.” Section 3 (d) of the Recov
ery Act empowers the President to
prescribe codes willynilly. Beyond
lie licensing and penalties—the
draft.
So far, NIRA is still on a vo!un-l
tary basis. No one will "be forced
to sign the blanket agreement any
more—or any less—than anyone
was forced to buy a Liberty Loan
bond in wartime. Signed, it is not
a contract and cannot be enforced
by any legal process or can viola
tions of its provisions be punished.
That is the official word .from
Washington. Of course, there is
a forgotten "Section 10 (a)’’ in
the Recovery-Act that authorizes
the President "to prescribe such
rules and regulations as may be
necessary to carry out the purpose
of this title . . . and any such rule'
or regulation shall be punishable (
by fine or not to exceed $1,000 or
imprisonment for not to exceed six
months, or both.” That may be
broad, enough to .cover any change,
of mind, but it’s entirely alien to
the present psychology of the • re
employment drive. "There is no
force here,” says Bulletin No. 3,
"except conscience and opinion.”
There is shrewd correction of the
errors here and a laying of past
uncertainties. For instance, some
industrialists were made wary of
codes raising labor costs by warn
ings against price-raising that Gen
eral Johnson intended fdr profi
teers but dispatched without a very
clear address. The blanket agree
ment specifically permits price in
creases "made necessary by actual
increases in production, replace
ment or invoice cost of merchan
dise.”
Washington is all done with the
wage-sharing plan of blessed mem
ory. It intends to increase labor
costs—or labor’s share of the in- C
come, as you will—but not to the I
point of killing the goose.
The question of what can be
done in the case of the unionized i
shop in which hours and wages are t
fixed by contract is more difficult, t
NIRA can’t break the contract, a

add that social pressure might, and i
social pressure is what he is going'1
gunning with. Employers and|a
unions are both likely to find this' c
out if either side tries to take re
fuge behind a contract. /
The long and -short of it all is
that this blanket agreement isn’t c
going to be perfect for everybody jl
but that the American people are.l
probably going to conclude that a 1
little individual injustice is less im-js
portant than the universal injus-1*
tice of the situation it is designed -
to meet. Furthermore signers will
get room to wiggle even in the
"straight-jacket.” If some parti
cular provision "because of pecu
liar circumstance, will create great
and unavoidable hardship” to a
igner, he may, after signing it
send in a petition approved by his
trade association asking for a stay
of that provision pending a sum
mary investigation by NRA—pro
vided he agrees in advance to abide
by the decision.
