The question snbmitted to the Attorney-General was : "Can the Gor man Government rightfully demand the surrender of the fugitive under the treaty of Jane 16th, 1852 T The Attorney-General aayi that the only point in controversy appear to be the following : Whether or not, ac cording to the true intent and mean ing of laid treaty, the Crimea com mitted by Yoght, in Belgium, were committed within the jurisdiction of Germany. The Attorney-General, in a lengthy opinion, review! all the facta in the oaae, and conclude ai follows ; I have carefully read the elaborate opinion of Judge Blatchford, uphold ing the jurisdiction in this case, trans mitted in yonr letter ; but, with def erence and regret, I au compelled to diaaent from his views. They do not at peer to me to be sound in principle or sustained by authority. Able writers have contended that it was a reciprocal obligation upon nations to surrender fugitives from justice, though now it seems to be generally agreed that this ie a matter of comity ; but it is to be presumed that where there are treaties upon the subjet, that the fugitives are to be surrendered only in eases and upon the terms specified in such treaties. Conforma bly to what is above stated, I make negative answer to your question. WAsaraoTOX, July SO Night. The entire debt of the District of Colum bia is officially stated at 19,230,781. A private letter received here by a prominent official from Moxico says that the Mexican government has de cided toaasnme an aggressive position towards the United States on an count of the McKansie raid on the Rio Grande SAT it is not feared that any efforts of retaliation will be the result. The truth is, the Mexicans are dealing very tenderly with that question and the punishment McKenzie inflicted on the treacherous rascals engaged in the depredations on the Rio Grande, is not regarded so much offered against the international law as some would have it appear, am jeusey. SAD ACCIDENT TO A PARTY OF EXCURSIONISTS. TWO MEN DROWNED. Atlantic Cm, July 22 Night Through the carelessness of some of the excursionists of the German Inde pendent Congregation and Harmony Singing Society a sad accident occur red here at 10 o'clock to-day. Ru dolph Kittiner, of Philadelphia, and Joseph Bush, of Camden, while bath ing ventured out about a half mile and in attempting to return were carried to sea and drowned. Chan. Smith of the same party in attempting to rescue Kittiner became exhausted after grasp ing him and was only saved by the no ble efforts and the superior abilities of the famous swimmer Boynton. Jules Favre attacked the home-policy of the government and exposed and de nounced the alliance of the Monarch ists and Bonapartista, Great disorder was followed by a vote of confidence of 400 to 270. This large majority, in favor of MacMahon upon the eve of the recess of the General Assembly, compared with the defeat of Thiers by 14 votes, is regarded as significant. Madrid, July 22 Noon. The crews of the Spanish men-of-war Almaza, Vittoria, Mendea, Nures, Fcrnandiel and Catolioo have revolted. The gov ernment proclaimed that these ves sels are pirates, authorizing their capture on the high seas by any for eign power on the high seas, and their treatment as pirate. Decrees have been issued dismissing Gens. Contreras and Piorod, and re moving civil Governor Cordovia, Mur eia, Peulevidra, Leon and Orenz. Gen. Pavia has been appointed Ctp-tain-Gencral of Andalusia andEstra madnra, Alieanto has declared itsolf an inde pendent Canton. The motion to censure thd govern ment for declaring the crews of the in urgent Spanish frigates at Carthageno, pirates, was rejected by a vote of 110 to 90. Biabbttz, July 22 Noon. The per son who attempted to assassinate Marshal Serrano, has been arrested. Bayonnb, July 22 Night News was received here through the Carlists Concerning tlio ii surrcctioa At Cartha gena which throws additional light on the disaffection in the Spanish squadron in that port, which was made a sub ject of government decreo and vote in the Cortes yesterday. The Insurgents, nfter gaining con trol of the city, seized the Custollo a strong fort on the west side of the har bor, less than 1,000 yards from the entrance which it commands com pletely. This gave control of the two lower batteries on tho shore at the mouth of the harbor. They hoisted the red flag of tho Commune over the fortifications, and summoned the squadron lying in the harbor (the crews being in sympathy with the insurgents) and the vessels fell in to their hands without opposition. The vessels thus taken by the insur gents are the Victoria, (iron clad of 21 guns;) Nuuancia, (iron clod of 25 gnus;) Petran, (iron clad of 40 guns;) Alma za, (screw frigate of 48 guns ;) and steamers Fernando, El Cataligo, Fer mi, and Blascon Garavay, not classi fied. The four vessels first named are among the finest in the Spanish navy. later. Madrid, July 22 Night It is re ported that the Iberian, which the Government sent to Carthagena to aid in quelling the outbreak, has muti nied and joined the insurgents in a body. At Vittora there are seven thousand Republican troops in a complete state of demoralization and disorganization. Several municipal officers have been murdered by the soldiers. The Republican troops at Cronqui navo surrendered to tho Carlists, on condition that their lives should be spared. In spite of the terms of the surrender, the Carlists shot a number of them after they had delivered np their arms. Don Alphonzo has sent the Spanish Government a formal proposition for the arrangement of a cartel for an ex change of prisoners. CUBA. ANOTHER FIGHT JUST ENDING AND ANOTHER CRISIS ' JUST BEGINNING. ( Havana, July 22 Noon. An official dispatch from Santiago do Cuba an nounoes a heavy engagement, but no particulars are given. There is a general want of confidence among the merchants. , Sterling and gold advance daily, and no faith is placed in the paper currency. A com mercial crisis seems inevitable. (JOTHAM. The real estate agents of Mr. Mills do not credit the suicide theory. Mills arranged with them the evening before his death for the completion of some building, and he was as cheerful ss usual. lfi income from real estate which these agents manage is $(0,000 per annum. Regarding the Georgia bonds held by the institution. Secre tary Rodman sail to-day that various emineut New York firms held the Georgia Umds and that the Broadway Bank holds $100,000 of thorn. He bo lieves that the company will pny every dollar it owed to depositors withort calling ou the stockholders. The as sets were reasonub'y good, though some of tho securities were slow. It is stated that the Congressional Committee on Transportation h ave is sued a circular to the State Granges of Husbandry throughout tho country, asking them to appoint delegates to meet tho Committee and furnish in formation ou tho subject, which they are investigating, and present tho viows of farmers of the different Stat s, iu regard to tho defects and abuses alleged to exist under tho present system of transportation. New York, July 22 Night Tho ill of the late E. H. Mills was placed in tho Surrogate's ofllec to-dny. It provides for tho deposition of an es tate estimated at $300,0)0. All is left to his widow whoso is appointed exec utrix in conjunction with his ion. brother and brother-in-law of the de ceased. THE NORTH WEST. ATTACK ON A TRAIN. ROBBERY THE OBJECT. THE ENGINEER KILLED, BUT THE PASSENGERS ESCAPE. YANKEE KU-KLUX. Cuicaoo, July 22 Night A special dispatch from Des Moinos gives (lie following account of au attack -on a train of tho Chicago Island k Pacifio Railroad, lost night : The train left Council Bluff at S P. M., with four coaches and two sleepers in the rear, the sleepers being filled with a party of aristocratic Chinese, on their way to New England colleges. There were also two baggage and eipross cars, in which was tho through California mail and express matter, consisting of nearly $2,000 in nn express safe and thrco tons of Bullion. When aliout sixty-five miles West of Des Moines, at about 8 o'clock, at a sharp enrve in an isolated spot, with no house within thirty miles in any direction, the train going about twenty-five miles an hour, tho engineer, John Ustlorty, saw a rail suddenly removed from its place. about sixty feet in front, and instantly reversed the engine aud applied the airbrake. When in the act of doing this, bullets came pelting into the en gino like hail. The engine ran into the bank of a tunnel, overthrowing the engineer and the fireman, the former falling On the latter dead. It is supposed that RafTerty was killed by tho concussion, as no bullet wounds could be found on his body. The flre- m an escaped unhurt. The train being very heavy, it ran about 100 feet and stopped. The baggage cars doubled and were badly smashed. As soon as the train stopped several largo, ath letic men, masked in full Ku-Klux style, appeared at tho express oar, in which was Conductor William Smith, Superintendent Royce, Express Mes senger John Burgess, and three other persons. Tho robWrs commenced to fire rapidly into tho car and to yelli, "act out of there, damn ye." Bullets passed through the clothes of the Con ductor and two grazed the Baggage Master on tho side of his head. The iumates of the car jumped out to tho rear under cover of half a dozen re volvors. Two of tho robbers marched np and down tho train, threatening to shoot any person who showed his head, aud saying " get down out of sight, damn ye, or we will shoot ye. The robbers then took about $2,000 of tho express money, opened the mail sacks, but took no letters, mounted their horses and rode off across the prairie in a southerly direction, the whole being done in' less than ten minutes. Fortunately they did not cut the telegraph wires, and Superin tendent Royce hastened to the nearest bloTanh station and talem-anlim! in all directions. . Engines and a posse were sentont from Council Bluff ou the Burlington and other roads to in tercept the robbers. Their dress and voices indicated that they were regnh r bu.shwhaekera. Thev evident! v iu - tended to g the uS"ni vaia - press matter by this route on MmdT, but which went through ou the epr. train Sunday night The robbers during the day stole a spike bar and hammer from the hand car house at the station. They drew the spikes at one end of the rails and secreted themselves several rods away, I and as the engine spproached the rails pulled out of place. Tho promptness of the engineer in reversing the engine and the use of the air brakes saved the passengers from harm and not one waa injured. The track waa , at once laid around the cars. The train at otx-e resumed its trip and arrived here at 7:30 this a. m., bringing the dead body of the engineer, who resided here and who leaves a wife and three children. 10. YA. DARING ROBBERY OF AN EX PRESS PASSENGER TRAIN. ENGINEER SHOT AND KILLED. Tho engineer, John Raflcrty, saw the obstructions in time to re verm) the' engino and apply the air break, but tho robbers observing his movement fired at him from an ambush and shot him death Tho en gine struck the logs and went off the track into a diU-h aud was followed by one of the bnggngo cars tho others re maining on tho track. Several passen gers wore bruised but none seriously hurt The robbers, who were marked, after opening and emptying the aufe of the Express nitssougcr of its con tents, rode off ou horseback. Among the passengers wcro thirty Chinese students en route to dpringflold, Mass. THE CHOLERA. ITS RAVAGES AT COLUMBUS. OHIO, AND AT MI. VERNON, INDIANA.
