The ofteuer the bill filed by Messrs, RodaKLL and Bailey iu the usmos of their negro clients, Dt goAN Holmes and David Oay is read, tlio more foroibly Is the reader struck with its audacity. i In order to appreciate it however, it matt be remembered that the two negroes Di'KOAN and David solemnly swore, and upon the Holy Evaugolists of Almighty God we presume, t)ut they knew the contents of the bill and that they were true of their own knowUdyt except as to certain matters "stated to be od their information and belief" and these ihey believed to be true. Messrs. IU'hhkll and Bailey, or one of them, drew the bill, at least their names are signed to it, and Dvncak and David awore to it. Now what are some of the bints these poor ignoraut creatures awore to be trne of their own knowledge? 1. David and Dunoan solemnly an jointly twear that David is now a res ident within the limits of the oily of Wilmington. In point of faot.lUviD Oat lives, we are told, in a houso belonging to Alex ander Oldham, Eaq, and situated not only outside of the corporate limits of the City of Wilmington, but outside of the limits of the county of New Hanover, to-wit in the county of Brunswick I Yet Duncan aud David both swear upon tho.lloly Evangelist of Almighty Ood that David Uvea iu the City of Wilmington and they swear this not upon ."iuformatiou aud be lief" but oi their own knowledge I 2. David and Dvnoan swear upon the Holy Evangelists of Almighty Ood, that ouder the amended charter "every elector it required as a pre requisite to registration and suffrage, to have resided ninety days in the particular word aud iu some particular lot or yard of said ward, mid fi rm of ninety day not tabu eoimt tdnp to the day of election but up to the time of registration." In point of fact the amended charter expressly requires the residence to be ninety days next preceding the cit e Hon. Duncan and David, however, olemnly swear upon the Holy Evangelists of Almighty God that the amended oharter requires a residence of ninety days preceding the registra tion, and they awear it not upon infor mation and belief, but of their own knowledge!" 8. David aud Duncan further jointly and solemnly swear that the Constitu tion of North Carolina "guarantees the right ot suffrage to evory male citizen, otherwise qualified, regardless of race and color, who shall have re sided thirty days in the county or municipality." Is point of fact the Constitution guarantees no such thing, nor does it even use the word "municipality" a single time in the Article denning the qualifications of an eleotor, And yet Dav and Dcnoan solemnly swear that the Constitution guarantees to any man, otherwise qualified, who has lived in municipality, thirty days, the right of suffrage, and they awear it not upon "information and belief," but of their own knowledge) Now upon whom, it may well be asked, rests the responsibility for this reckless swearing T Does it rest upon the poor ignorant, uneducated negroes Duncan and David, who swore td the bill, or does it rest upon the 'iuteUi rent and educated attornies Messrs, r.csBCLL and Bailey, who drew it up I r f1 "n to Swear to? . , Leiiier David lived in Brunswick or ia ITcw ILmovor county is a fact t' i.t t.9 t'ioriJes might well be Igno r ic ', ! t f t f -y did not know tlat the 3-.oti.li-J ol.art-T J; J in-t re- qnire nini f j ivg ,eM.hi;ie ii-it j n -ceding the registration, etu r-irt.jiiT imjvssili'e jut a iuiK.sil!t, it vents, as that tiny should not kcow that the Contitu!iin mj cot a word abont "ni'inii lpati';t" in tLe rutue Article relating to suflYape. The I inestion is one of ethics, of hieh t, we do not assume to be the arbiter, Our pnrpo now is simply to show up iu its true colors this grent bug-bear, gotten up to frighten our people. If the people of Wilmington allow themselves to be friKbtemd from their propriety by such means we shall indeed be surprised. , In conclusion, we beg leave to call special attention to the commuuica tiou signed Civw, which we print elsewhere this morning.
