Time waa no judicial exhaustion thou. Of oourse we refer to the oase of Nichols vs. MoKee, 68 N. 0. Reports, p. 129. This was at January Term, 1873. But still the Court waa not satisfied The Democratic Legislature still fought it unequal fight in behalf of Democratic government, and although o shorn of ita strength was still a power not to be despised. Th Court was therefore not yet oontent the tew remaining powers might be taken from , th Legislature in an'jstanoe, though not in form. Aooordingly, in lit tie leu than two years, a third ease was before th Court and third decision rendered. Thia time the decision is substantially that the Legislature must exercise those few remaining powers subject to th revisory or Veto action of th Court I This was don in th Wilmitfgton City Cass just decided. Certainly there i now no judicial ex haustion; certainly the ancient maiden is both fully able and willing to save her virtue even though it be a little stale, and tainted.
