takes his wife for her health. Mr.
Bayard was opposed to the extra session
of congress and much rcgreted that it
was called, yet he thinks it was un
avoidable ; but he thinki it will be ol
great use io defining the relations that
roust be expected to exist between Mr.
Hayes, during the remainder of his
term, and the Democratic majorities in
the two bouses of Congress.
lie thinks lbs repeal of the test oath
and the formation of the improved
system of obtaining impartial juries were
aloue a sufficient recoiupenco to the
cjuntry and to Congress for all the ex
pense and harassment of the session .
The reforms found liltlo favor with the
President, but they have been approved
by tho people and will bavo a good
effect.

We publish below the act passed by
the last Legislature forbidding the carry
ing of concealed weapons, People should
heed this law and not be forced to a
trial iu the courts. It is a wise law, and
we hope the grand juries of this county
will see to it that the law is not disre
garded. The General Asstmhly of North Caro
lina do emtct i
Six. 1. That it shall be unlawful for
aiy person io this State, except when
upon his own f remises, to carry con
cealed any p'u-tul, bowitknifr, razor,
diik, dagcer, slingshot, loaded cane,
bras, irnu fir tuctulic knuckles, or other
deadly weapons of like kiud.
Six. 2. That any person ( (Tending
against section one of this act shall be
guilty of a misdemeanor, and upon con
viction thereof, shall be fined or im
prisoned io the discretion of the
court.
Skc. 3. The following persons shall
be exempt from the provisions of sec
tion one of this act : Ollicers and sol
diers of the I'uitcd States, while in the
discharge of their official duties ; officers
and soldiers of the militia of this State,
when called iuto actual service ; ollicers
of this State or of any county, city or
town of this Stnte charged with the ex
ecution of the laws of this State, whilo
in the discharge of their olliciul duties.
Six. 4. Any person being off his
premises and having upon his person
any deadly weapon described in section
one, such possession shall be prima
facie evidence of the concealment there
of. Skc. 5. This act shall go into effect
on the first day of July, A. D. 1379.
DEATH Ol WILLIAM ALLEN.
Hon. William Allen, ex-govcrnor of
Ohio, died suddenly last week at Lis
resideoce io Ohio.
Mr. Allen was an extraordinary man.
Self made, occupying a conspicuous posi
tion in public life for many years. He
was born in 1800 at EJentun in this
State, lost bis parents early, went to
Lynchburg, Va.. living there until 1H22.
working at the trade of a saddler as an
apprentice. From there be went to
Oaio, where his ha f sister, the mother
of Hon. Allen G. Tburman lived. Mr.
Allen was poorly educated and being
poor nade most of the trip on foot, iu
saidwinter. He went to school two
yeana and then weut into a lawyer's
office. He obtained license to practice
law before be was of ae, and achieved
considerable reputation as a lawyer
before he was twenly-four years old
particularly in criminal cases. He was
nominated by the Democrats for con
gress io 1833, i:i a district that bad a
large whig majirity. He was defeated
by a very small majority and ran 1.500
votes a head of the ticket. He was
elected I'uited States Senator io 1X37
wheo be was only thirty-one years old.
In the Democratic national conven
tentioo which convened in r.iltimora in
IMS. so bitter was the contest between

nomiaation that a committee composed
of frieods of bith thoe gentlemen was
aent to Mr. Allen requesting him to
accept the nomination and in that way
settle the difficulty. He persistently
refused to allow his name to be used on
the ground that it would be bad faith in
him to allow it because bo had been
the chief advisor of Mr. Cass during the
campaign, and acceptance would be a
Vetrayal of bis friend. Ho canvassed
New York and 1'ennsylv'ania for Mr. Cass
and then retired from public life until
1874, when he was nominated by the
Democrats fun Governor of Ohio and
was elected by about 1,000 majority,
being the only, one on the ticket that
was not defeated. He was again oomi-
rated in W7C but was defeated by Mr.
Hayes now President, He has retired.

without danger of Interruption.' Mr,
lhtcbelor is out of the State to avoid
arrest. I need not say that tho matter
should be held a profound secret. You
can return answer by the bearer of this.

aud myself, should they become neces
sary, lou say that as he has awaited
my convenience one week, that in com

loss to see how I have iuconvcuienced
"either you" or "him." If you will
allow me to recapitulate iu a brief way
the fcencs in this play in which I have
acted, they are these : O i the 20th day
of June. I received a letter from you,
notifying me that ynu had a letter for
me from Mr. lUtchelor, and expecting
me to come to Hilifnx. This let

much I oiight have been inclined to ac
cept this interview. I say to you-inalh
candor that I could not have left this
place, even on business for several dajs
thereafter, without having been arrested j
for before I had gone a hundred yards
after genii); your letter, I met a peace

I replied to him that I didn't know Jo
Lockhart. Then he went on to tell me
that it was generally known in Weld in
that Mr. Ritchelor had gone to Virginia
to meet me, and thit a centleman from
Raleigh bad iuforaied lii o that the
same thing was current unon th streets

have been arrested. Why the fact was
knowu that you had written to me, I
am at a (t know, but I do remem

o'clock in the morning" was but irn
pmper and i j idicious. You certainly
louk me greatly by surprise and at still
greater dissdvantuge. 1 ou must bave
known that your coming at such no un
usual hour was enough to excite the sus
picion of every inmate of the housa

opportunity to consult a friend, if I had
wanted to do so. Kven then I dij out
refuse to accept Mr. R'a. challenge, as
you say I did.. If you will remember, I
told you that I had consulted no one,

and that, if 1 did, I would iuform
you this 1 did do, aud mailed a letter
to you iu less than hall w hour after
you left.

nothing of "the code" but what good
men should despiw, that ynur Mr.

upon the presumption that I was the
challenging party "he" leaves the
State and goes to Virginia "he" as
sumes that it will be necessary for him
to again pass through Wcldon and
then "he" must be allowed to select the
"time" and "place." I suppose that I
would have some rights and that I would
have to be consulted.
I do not propose to dictate to you or
to Mr. Ratchelor, as to how you shall
proceed in this matter, but it docs seem
to rue that it would have been more be
coming if be bad sent bis message to
me at any other place than my home,
at a lime other than night when my
family would not have been disturbed
and frightened. I bave written this to
show you bow much inconvenience
have really caused Mr. R itchelor.

In this letter you demaud a retraction
of, and an apology for, the ' charge"
contained in my letter to toe News of
the 5'.h inst.' There is no man who is
more ready to make proper an, cuds for
an n jury ur even an n justice do;.e his
fellow-man, than I am, when convinced
or shown that I was in error. You
wrote a Utter in which you made grave
charges against a friend uf mine. I
have made no "jharges" against you. I
pronounce charges which you made
false. I still believe them to be false.
Now before I will ever "retract" or eveu
"modify" my "assertions" that these
charges of yours are false, you must
first show me that your charges are true.
When this is done to my satisfaction, or
to the satisfaction of the public, or to
tho satisfaction of any gentleman, I will
not only apologize to you, hut I shall
deem it my duty to publicly acki owl
edge that I have done ynu a great
wrong. Hit until ynu do prove your
"charges" to be true, my own opinion is
that you have no right to demand a re
traction from me, or to bo in any way
recognized by me. Therefore I nntify
you now that I will receive no commu
nication from you, nor recognizi iu any
manner any message seot by you, ex
cept it be a communication in proof of
the above named charges. This may
be at variance wkb that "code" which
jou "honor," and which I despise.
I don't know that it is, but it is in strict
accordance with that codo which I
honor, just and honorable dealing be
tween man and man for I don't believe
any code nf law, morality or common
sense reqiire me to retract assertions
proving "false," charges which you have
made, until you show them to "be true.
