Smith. This latter as wc stated at thc time had been arrested on suspicion of having committed the, murder and wc learn now" that ho was accjuitteof on thc preliminary exanination before a board of Magistrates. Messrs. T. II Sutton Jr., and N. A. Stcdman appeared for the - defence and Messrs. R. II. t C. C. Lyon represented the prosecution. The superior Court Clerkship. It . is rumored that the papers relative to the decision of .the Supreme Court, which ejects Mr Ilcaton from the Clerkship of the Superior Court, have been received here, but we can trace these rumors to no positive source, although we blieve that they have been received. The appoint ment will rest with the Judge of this p - District, and it will therefore be with either Judge Seymour who is now riding this Circuit, or with Judge McKoy, who has been, regularly commissioned as Judge of the Fourth Judicial District. Wc incline to this latter view, and we also understand that this opinion is held by prominent lawyers in the city.
