The first case called was David Mallett, colored, charged with being drank and dwn.j Sentenced to one day's impris onment, i ' Enoch1 Griffin, colored, charged with disorderly conduct was neiton the docket. Defendant discharged. i The principal case on docket, which occupied the attention of the Court the rest of the forenoon, was then called The defendants being John Grady and Gerrge Hay, members of therkst Ward fire bucket company, (colored) j who were charod with assault and battery with a deacTJy I weapon with intent to kill upon the jerson of jJohn Tayltr, colored, on last Saturday night durlngthe alarm of 6re on the West side of the river. Mr. Solicitor Mtore appeared for the State, M. Bellamy. Esq., for defendant George Hayes, and John L. Holmes, Efq , for defendant John Grady. Numerous witnesses were called for the State, the defence having none. The first to take ' the stand was Dr. J. C. Walker, city and county physi cian, who testified that he had been called in to see John Taylor, a wounded man whom he found paralyzed, lyiog in an unconscious state and in a , very critical condition from a wound in the head about one to oue and a half inohes long, which looked ai though it had-been made with a blunt jagged instrument; The skull la thought fractured, and he considered tbe recovery of the iujured nan exceedingly doubtful. After Dr. Walker V testimony had been given ether' witnesses were called. The first being James E. D Izon , a colored man, who swore in substance that on the occa sion of the fire, last Saturday night, tbe Captain of the Bucket1 Company, David .Nixcn, and others, were on the flat of John Taylor, colored, at the foot of Prin cess street ; that he saw Nixon and Tsy 1 r in a tussle. That George Hayes, one of the defendants, and others were pulling another flat down the river, alongside of Taylor's flat. That just at this time he heard.some one say. Don't you see our Oiptain in a difficulty ?'' and saw George Hayts raise a hook of some kind and strike John Taylor on the bead when Taylor felljthat he, witness, was itaading batween Taylor and defendant when the blow was struck; that after Hayes struck tbe blow he pulled ; the book to him while st III in the- stricken man's bead. Daniel Nixon, John Grady and several others were standing on Taylor's flat at the time the b!ow was struck. Hayes struck the injured man with the sharp part of the hook. After striking the blow Hayes jumped from 'the outside flat on toj Taylor's Sit. The blow knocked Taylor down and be would have fallen overboard, but Dave Nixon caught him and palled him on the flat. The foregoing testimony was all that was offered in confirmation of the blow beiof stnick by Hayes. Other witnesses, among thea George Carey, the nephew of the injured m .n who was on the flat at the time, and Nelsen Robinson, the partner of Taylor oa the flat, both swore to having Been the blow struck and identified John Grady, then in Court on trial, as the man who struck the blow which? knocked John Taylor down. Tbe testimony of officers Alien and Ever ett of the police force, who were present and made the arrest of Grady and others as soon as they could reach them through the crowd corroborated the testimony given by Carey and Robinson. Even the fireman's hat, which defendant Grady had in Court with him, and which the witnesses, Carey and Robinson, swore he wore on the occa sion of the difficulty, was identified as be-1 ing in the opinion oi the two witnesses the same hat Grady wore' when he struck Taylor." - At the conclusion of the examination of the witnesses, Mr. Bellamy counsel for George Hayes, made.a motion for his dis charge which the Solicitor, OoL Moore, did not oppose, inasmuch as he stated, that the evidence of Dixon, he did not denn sufficient to warrant the detention o! tbe prisoner. Tbe Court thereupon dis charged the defendant, George Haye Mr. Holmes count! for Grady then made an appeal to the Court la his behalf and r .questing that' he be discharged as the testimony of Dixon, clear j exonerated his dieat; and implicated Hayes, and in asmuch also as the testimony of David Dixon was rather oo fiicting la resard to Grajirc4tioa on, the xi wlsa ths Kow wasslrmck. The Court took a difierant view, however, and committed the defea dant without bail to jail to await his trial at the next term of the Crimioal O urt.
