His Honor then listen ed to argument by counsel of the Bell Telephone Company who are defendants in a previous case, already reported by us, in which a verdict of $5,000 damages and $900 for viola-ion of contract was awarded by the jury to the plaintiff. Tbe motion entered by defendant's counsel for a new suit wan not allowed but Judge Graves stated that if the de fendant would not agree to accept $500 instead of $900, for violation of contract, he would set aside the verdict and that he considered the award of $5,000 dam ages as excessive. The counsel for the plaintiff agreed to the proposition of $500 and the verdict remains as amended by the Court, $500 for violation of contract and $5,000 dam ages for the UbeL The counsel for de fendant appealed from the ruling of the Court in refusing to grant tfceir motion for a new trial.
