SENATE. ' Monday, Feb 2. The Senate met at the usual hour. President Stedman in the chair. Mr. Franklin, from Ekin, Surry county, ami Mr. Chadbonm. Iroin rur chanis of Wilmington, petition, bath asking the repeal oi merchant tux. The following bills were inirwiuced and referred to appropriate committees or disposed of as follows: Mr. Fool, bill to create a railroad commission. Subsequently on ruction of Mr. Fool this bill and another rela tive to the same matter was ordered to be printed. Mr. King, bill to make it a misde meanor to mutilate or otherwise deface siens. Mr. Bond, bill to amend section 11-25 oi the Code, concerning .arrests when summoned to acsist officers. . Same, bill to protect marshals of the State. Mr. Williams, resolution of instruc tion to the com mittee on penal insti tutions directing their special attention to the leasing and working with con vict labor certain farms near this city of whom purchased or leased, amount of fertilzers used and from whom pur chased ; what crops raised and what dis position was made of the same, &c Adopted . Bill to ameud an act to incorporate the Wilmington Coast Turnpike Com pany passed its several readings. B:ll to amend section 549 and 550 of the Code to regulate appeals from the Superior Courts. A substitute from judiciary committee was adopted and passed its several readings. Bill to amend an act to as to make the statutes of limitation applicable to suits brought by married women, was on motion of Mr. Buxton referred to the judiciary committee and ordered to be printed. Resolution instructing the secretary ot the Senate to procure certaiu infor mation from the Register of Deeds ol the various counties m the Stale as to ex-Con federate soldiers &a.. tailed u pass Bill to incorporate Hope Milis Manu facturing Company in the conuty oi" Climber land passed its several rea-.J-ine. Mr. Buxton offered "to amend a follows: Provided that the provisions of this act shall not be construed tojre late to entries made by parties win nave not taken out grants at the time of the passage of this act. Without action on Mr. Plumb's amendment the Senate went into exec utive session and when the doors were re-opened, the Senate adjourned. HOUSE OF REPRESENTATIVES Mr. Collins, of Mass . moved that the House take a recc-s until 1 1 o clock to morrow. This was done for the pur nose ot continuing the legislative day of Monday, in order that an opportunity may be had to move the passage ot the bankruptcy bill under a suspension of tbe rules. Mr. Thompson, of Ky.. interposed a motion to adjourn. Lost. Mr. Mouiton, of Ills., then made some filibustering motions on which the roll was called. Roll call followed roll call in mono tonous succession until 9.20 p. m., the friends of the Bankruptcy bill being in a majority ranging from two to six and voting down every motion to adjourn. The attendance of members, which at the beginning of the struggle was large, aggregating about 250. gradually dwin dled away until at 0 30 there was but half that number present if On to Richmond. The changes in tbe Atlantic Coast i Line railroads since the recent consoh dation went into effect on Sunday. The UOMMEKCIAL HjEWS. LOCAL NEWS. Waived Examination Charles Geyer, colored, was brought before Justice E. D. Hall this morning, charged with an assault by shooting with intent to kill John Allen, also colored. The offense for which Geyer was brought to trial was committed on the night of the 22ud of January last. Upon an affidavit made on the next day by Turner. Geyer was arrested and required to give bonds for his ap pearance whenever the condition of the former would permit him to be present and testify in the matter. To-day Tu.mor was present. Geyer was also present and his interests were repre sented by Mr. A. D. Ricaud. When the case was called Geyer, through his counsel, waived an examination, and the accused as held for his appear ance before the next term of the Criminal Court "under the bends al ready given, and tbe witnesses for the Stale, were recognized for their appear ance before the same ttibunal to testi l in the matter. A message from the Governor was announced, which was an invitation from the managers to the State officers and the Legisl ture to visit the World's Exposition, at New Orleans, stating that all necessary courtesies and con veniences would be ex' ended if the in vitation was accepted. , Bill authorizing the city of New- berne to issue bonds for the purpose of making city improvement!), passed its third reading. Bill to amend section 3443 of the Code. Mr. Overman explained lha'. the bill provided for hiring prisoners tor public wrk outside of the countv in which they were confined, and that as this would place the regular prisoner by the side of the striped suit ed convict, the judiciary committoe re ported adversely. Mr. --Green said he though' there was merit in the bill, and that it should not be hurried over, and as he wished time to more fully inves tiga'e it, he moved to postpone action until Thursday next. Carried. Bill to amend sec. 3148 of the Code, passed its several readings. Bill to amend sec. 2017 of the Code, Mr. Pou said tbe bill authorized the overseers of public roads to extend the time at pleasure, and as desired to have them restricted, he opposed tbe bill Mr. Felton thought that six days was enough each year. The bill was ta bled. Bill to amend sec. 2832 01 the Code, failed to pass. IN CONGRESS YKSTMKDAV. SENATE. Washington, Feb. 2. Tbe ICbair laid before the Senate the credentials of John C Spooner, elected U S Senator from Wisconsin for six years from the 4th of March nexi. Also, tbe credentials ot tbe reelection of Senator Vest, of Missouri. Also, tbe President's message relating to the 'Alert," recommending its ire turn to tbe British Government. On motion ot Mr Dolpb, th Senate took up the bill to repeal the preemp tion and timber culture las. After some discussion, by Messrs Dolpb. Morgau and Cockrell. the bill was dis placed by the Inter-State Commerce bill, consideration of which was re sumed. - A vote was taken on Mr Beck's amendment to strike out from the House bill the provision relating to equal facilities and accommodations of passengers. The Senate, by a vote ot 22 to 33. refused to strike out the cause. The bill provides that railroads shall not charge more for a shorter haul than tor a longer haul, that includes tbe shorter. Mr Beck moved to amend this so as to prohibit merely charging more for transportation "any distance less than the whole length of the line than is charged for similar service over the whole length of the line. To this amendment several others followed amid the long debate. One coupon of the denomination of $15 wus burned in the presence of tbe Board. Tbe Register of Deeds submitted bis report for the months of January and ! December, showing the amount of fees for marriage licenses to be $17 10 lor the former and $1GJ15 for the latter month, and exhibiting tbe Treasurer's receipts for the same, which were re ceived and ordered on file. It appearing to the satisfaction of tbe Board that an erro'r occurred in tbe listing of James Strutber's taxes for the year 1884. it was ordered that the same be corrected and that the personal property tax charged against him in tbe city of Wilmington be remitted, and that the same be charged against him in Harnett township. It was resolved that the Chairman be instructed to transmit the resolution referred to the Board of County Com missioners by tbe joint meeting of Magistrates and 'County Commission ers, held January 5h. to Lieut. Gov. Stedman, our members in the Senate and House of Representatives, and any other members ol the General Assem bly that he may see Jit; and to urge them if possible to secure the necessary legislation to create a small Criminal Couf Circuit, not to exceed five coun ties, (including New Hanover), and to provide in said bill for the election of a Clerk and Solicitor in each county in said circuit by the Board of Magis trates or County Commissioners of each county, as they may deem best. The Board resolved itself into a Board ot Education. A per capita distribution of two dol lars ($3) was made of the school funds of New Hanover county. It was ordered by tbe Board that the one hundred and forty-two white children in District No. 5 receive of tbe $208.88 collected under the local as sessment act $150.91. and the forty seven white children in District No 7 receive of the $208 88 collected as above $51.97. The report of the County Superin tendent was received and ordered on file. Also, the report ot Mr. Don MacRae, Chairman of the School Committee of District No. l. and the report of Mr. James H. Chadbonm, Chairman of the School Committee of District No. 2. The Board adjourned subject to the call of the Chairman. were counted by the Board, a state ment of which will be found elsewhere in this issue. Mr Calder moved that the Chair man be authorized to sisrn a note for $4,000 (six per cent, per annum inter est), being a renewal of a note dated February 5th. 1884, and given to Mrs. C. C. Drace for tbe improvement of North Water street. There is another note of $7,000, bear ing 8 per cent, interest and payable to Mr. W. H. McRary. which will fall due on tte 5th inst.. and will have to bo renewed. Yesterday forenoon a sailor, named Carl Gossel, belonging to tbe German barque Hoofnany, Capt. Fretwurst, now iving at Fowler and Morrison's wharf, while at work in tbe mizzen ton, by some accident lost his baiar.ee and fell. In his descent he struck the starboard mizzen ringing with such force as to break one or ratlines. It a'o broke tih own fall, and caused the rigging in rebound with such force a3 ;o throw him overboard. Mr ward Rice, first j-fficer of the schooner John A. Griffin. Cpt. Rice, being near at band, immediately threw a line !o Gossel, who. ftransre to say, did not seem to be much injured and had be gan to swim towards the shore as soon as he struck the water. Gossel caught the line and with the help of a number of sailors, who bad flocked to his rescue, was drawn on board a flat tnat was lying near by. In his fall he turned complete somersault and in falling: from the ringing he struck the rail of tbe barqnn wbicli wrenched his back some what severely. This was his most se, rious injury and will probably keeD him from work for four or five daj s. There were quite a number of scratches on his face, but these injuries were slight He is about 24 years of age and may consider himself as a iuckv man in es caping as lightly as he did.
