Section I. ThatcjarU of rec nl to
he called The Criminal Court of New
Hanover count v" and ' The Criminal
Court of Mecklenburg county" respec
tively, are hercbv establi&hed
Tne Criminal Court of New Hanover
c unty Shall be held in the city of Wil
mington, in said county oi New lian
ver. and the Criminal Court id Meck
lenburg county shall be field in the city
of Charlotte, in said county of Meek
burg.

tiveiy, hereby established, shall posses
all the powers, perform all the duties
and be subject to ail the restrictions ot
a court of record, according lo the laws
of this Sta'e.
Sec. 3. That the said Criminal Courts
shall have exclusive original jurisdic
lion to enquire of, hear, try and deter
mine all crimes, misdemeanors and
offences, committed within the coun
ties of New "Hanover and Mecklenburg
respectively, tuily and to the same ex
tent as the Superior Courts of the Slate,
aud exclusive appellate jurisdiction ot
all offences tried and determined before
a justice of the peace or oiber magis
trate in said counties respectively.
Sec 4. That the said Criminal Courts
shall have all the jurisdiction, vested i
iho Superior Courts, to try all crimes
and criminal offenses originating with
in thi said counties of New Hanover
and Mecklenburg respectively, and lo
give iod&ment ami award execution
therein, and for the recovery ot ail
fines and forfeitures, and tat liie pro
ces. pleading, practce and modes of
proceeding shail be tbe samu in said
courts as prevail in the Superior Courtis
of tbe S Hin in such cages as aforesaid.
Sec. 5. That appeals to the Superior
Court, and writs of error may bo prose
cuted from the judgments ol said Crim
inal Courts, in the same manner as
tbey may be from tbe Superior Courts.
See. 0. That there shall be one judge
t said Criminal Courts, who shall pr --ideovpr
both of the said courts, to be
appointed by the Governor of the S'ate
bv and with the consent and confirma
lion ot tbe Senate, wbo sh-dl receive an
annual salary of two thousand five hun
dred dollars, to be paid eq .ally by the
said counties of new Hanover and
Aleck le:n burg, in quarterly instalments,
as hereinalter provided, and the said
judge shall take the oath prescribed
;or judges i f i tin Superior courts, and
he snail posse: ihe qnai ideations of a
judge ol the Superior court, and shall
nold his office tor a term of eight years,
unless removed from office as in tbe
ext. section provided.
Sec 7. That such judge mav be re
moved iroru office for the same causes
aud in the same manner as a judge ol
mo Superior Cour , and all vacancies
in said otiice shall be rilled by appoint
ment of tbo Governor, and the pern
ho appointed by the Go pernor shad bold
his office until the meeting of the next
General Assembly shall elect a per.on
io fill the said office lor the unexpired
term.
Sec 8. That the judge of the said
Ci immal Court shall be a conservator
of the peace within said counties and
shall have all the powers mf the several
judges of the Superior Courts ot this
Stfite to hear and determine all crimi
nal cases rising w thin said counties,
and the like powers to is-ue warranto
r precepts lor tne arrest oi criminals
anywhere within the limits of the' State
administer oaths, issue writs ot habeas
corpus, and hear aud deteimine the
same, in the same manner as the judges
ot the huperior Courts.
Sec. 9. That there shall be a solici
tor tor each of tbe Criminal Courts
who shall be appoiuted by the Govern
or, oy and with the consent and con
tirmatinn of the Senate , and who shall
hold his effice for the term of four years
and until his successer is aualitied.
He shall be a resident of the Cuunty tr
which be is chosen, and shall receive the
same l-es as now allowed bv law to
ttie si licitors of the several judicial dis
tricts, and in addition thereto shall be
paid n annual snlary, in quarterly
installments and ot such a sum as the
commissi nets and justices of the
peace may allow for performing the c'u
ties of his officer hereinafter prescribed;
said sum to be paid as herein provid
ed, upon the certifiea'e of the clerk of
sad court that hu has attended the
terms of said court and discharged the
duties ot his rffice. Should any va
cancy cccur by tbe death, resigua ion.
refusal to accent or removal from office
of said solicitor the judge shall have
tbe power to appoint a solicitor for the
unexpired torm. The dutks of the
solicitor shall be the same in respect to
criminals matters arisimr in the said
county, for which be is chosen, as those
prescribed by law for the solicitors of
the several judicial districts of ihis
State, and he shall take a similar oath
of office, and be removable for the
same causes as tbe solicitors of the sev
eral districts of the State. He shall at
least once in ever? three months, make
an examination of the office of Register
t Deeds end tbe Superior Court Clerk,
in the presence of Ihe respective offi
cers;andthe said Register of Deeds
and the clerk of the Superior Court
shall furnish every facility to enable
the solicitor to make such examination
ftor tbe purpose of ascertaining whether
inventories, accounts of sale, accounts
current, wills, deeds, bills of sale. ffi
cial bonds, mortgages and all other pa
pers required or allowed to be recorded
and registered and properly indexed;
and also whether tbe several dockets
and records or papers of tbe different
courts, including justice of the peace,
have been kepi and filed in the proper
manner and as required by law. The
judge and solicitor of the said court,
when duly app- in ted and confirmed, a
herein provided, shall be commissioned
by 4hc Governor in like monei as the
judges and solicitors ot tbe Superior
Court.
10. That the aforesaid Solici
tors shall make a faithful report In
writing of the several matter hereby
directed to be examine'!, specially
stating in what repect, if any. there
has been an o mis-ion of duty by the
officers aforesaid, and the said report
shall be made to the aforesaid Crimi
nal Court at the next term thereof,
which shall be held subsequent to such
examinations, and when it shall
appear irom such reports that there has
been an omission of duty on the part
of any ot said officers, the said solicitor
bali enue an indictment to be prefer
red fr such reported breach of duty,
and on conviction the defendant shail
be fined, or imprisom-d, or removed
from office at the discretion of the
conrt: Provided, however, that this
indictment shall not exempt any of said
officers irom being indicted for other
breaches ot duty, as prescribed by law.
Sec il. There shall be a clerk for
each. of said courts of Mecklenburg and
New Hanover counties to be appointed
by the Governor, confirmed by the
S natc, and c mmissi med by the Gov
ernor, as ben in provided io the casus
of the judge and solicitors, and said
clerk shall enter into bond wnb goo !
md sufficient security in the sum oi
ten thousand dollars to be approved by
the county com missioDers, payable to
the State of North Carolina for the
faithful performance of the duties of his
office, which bond shall be renewed an
nually, and recorded as other official
bonds; and the person so appointed as
clerk for the said court shall hold his
office for the term of four years, and in
case ot failure of the person so appoint
ed to file said bond on the first day of
the first term which shall be held of
said court, or in case of any vacany ac
cruing from any cause whatever, the
said judge shall have lull power to ap
point another person to fill said office.
And he said clerk shall perform ail the
duties incident to his office, and shall
receive the same fees and compensation
therefor as is now allowed by law to
the c erk of the Superior Courts for dis
charging the same duties and the same
clerk shall be removablo from office
for the same causes as is now provided
by law for the removal from office of
the clerks of tbe Superior Courts.
Sec. 12 That the Sheriff of New
Hanoyer county shall be the sheriff of
the Criminal Court of said county, and
the sheriff ot Mecklenburg county shall
be the sheriff of the said Criminal
Ccurt of Mecklenburg county, and
each of said sheriffs, by hiraselt or his
lawful deputies, shail discharge all the
duties incident to his office required of
him in relation to the business of the
said court, aud for a failure to perform
t he same shall be subjected lo ail the
penalties and liabilities uow prescribed
by law
Sec. 13. That it shall be tlie duty of
the board of county commissioners of
each pi the said counties ol New 11 an-
vei and Mecklenburg io provide for
the payment of the saiaries of the judge
and licitor and the fVes and compen
sation of tbeelet k and the sheriff ot
said, courts respectively, and the pay ol
jurors and witnesses and all other ex
penses incident to said court by order
on tiic county treasurer oi said respec
tive counties, which order shall be paid
by said treasurer out of any moneys in
hts hands not otherwise appropriated by
law. Sec 14. That the commission rs of
each of said counties shall provide the
necessary books to be used as dockets
by the said court, and also a seal for
said courts, with such a device as the
judge ot the court shall prescribe, and
shall furbish a suitable room or office
for the use of the clerk of said court.
Sec. 15. That there shal be mix 'eru.s

1st Monday ot June;
2nd Mon.iay of August ;
2nd Monday of October;
1st Monday of December;
and said courts shall continue their ses
sions tor the term ot two weeks, it the
business thereof shall so require, and
the judge ot said court shall have pow
er to hold special terms of said court
whenever it shal seem necessary to
him to order the same, of which order
fourteen days of public notice shall be
given in tbe manner to be prescribed
by the judge and at such special terms
he may make all orders and do any and
everything which he can do at. the regu
lar term, and when such special terms
shali. be so ordered, ali process and pre
cepts returnab e. to the next regular
term, shall be deemed returnable to
such special term, and ail recognizances,
bonds, obligations ami summonses

Sec. 16. That in cases of change of
venue from the Criminal C uv: of New
Hanover or Meek lee burg county, ap
plied for on account of the interest.

shall not be transferable to another
county tor trial, but the judge mav or
der it to be transferred to the Superior
Court of said county, but any party
desiring a change of venae from said
Criminal Court ou account of any otner
cause may, upon application to the
judge, obtain a removal of the same t
any adjoining county under such rules
and for such causes as are prescribed
by law lor the removal .of criminal
causes from one county lo another

Sec. 17. That if the judge of the
said Criminal Court shall fait to attend
to bold court on tbe day designated for
a regular or speeial term, it. shall be the
duty of the c erk to open and adjourn
the court tor tbe two first days of the
t rm, and if the judge shall not attend
bv four o'clock on the $econd day ol
the term, the court shall be a ijourn d

Sec 19. All jurors who shall attend

are required bylaw in regard to jurors

a special venire, the number of which
shall be designated by the presiding

term of said court, under the supervi
sion of the chairman of the board of
county commissioners, or some other
member of said board, and the cletk
of the said Criminal C urt, by a boy of
ten years of age or under, from a bx
containing the names ot the qualified
jurors of said county, to bo furnished
by the county commissioners, ami the
said special7enire shall be drawn and
the list given to the sheriff ot said
county on not less than the day pre
vious to that on which the jurors of
said special venire are requirtd lo
