This section, which has been in force for j ear, is now changed so as to make the -forfeit to the sterifl' of the county in which said act is committed, and nilows the sheriff to. have amount so collected. : Sec. 15. Is unchanged, I r relates to general agents. Sec. in. Relating to contracts of in surance with outside companies is stricken out and the following in sub stance inserted, viz: That whenever any risk in the State demands a greater amount of insurance than can be procured from companies licensed to do business in tbe StaCe can furnish, then in aucb.ease. any broker or agent can procure such excess in outside companies; such broker 6r agent to make immediate returns of same to secretary of S:ate with affida vit that the said excess could not be procured in. the State and 2 per cent tax on the r iemiums thus received. Sec. 17. Has been the bone of con tention lor two years past. It forbids tbe use of the general average or float ing policy and the co-insurance clause, which clauses are universally in use on cotton policies. On the passage ot this section in 1885. the companies resorted to the use of the altercative clause marks and numbers which was justly regarded by. not only the assured, but agents as well, as a great hindrance to insurance. Petitions), numerously signed, asked for a repeal of section 17, and we are assured that as soon as the new aw is printed and sent to the companies, that they will at once withdraw the marks and numbers method, and will insure cotton as in 1884 by tbe use of the co insurance, geoeral average ot floating policy. The repeal ol this section will allow our cotton factors to procure in surance in companies licensed to do business.in this State freely as prior to lowu. Sees. 18 and 1.
