Haynes, of the schooner Cyrus lid I, identified the hawser as belonging to his vessel and stated that it was stolen between Saturday night and Sunday morning. The defendants said that they found the hawser on a ratt, but the Court was ot the opinion that they were guilty and b und them over in tbe sum ot $100 each for their appearance at the next term of the Criminal Court; in detau.lt of which they were committed. Scales on Saturday la?t, the purport ot which was that, regarding the warrant of execution in the case of John Jones, there plight possibly be error. Tbe law under which His Excellency issued the warrant was passed at the last session of the legisla ture, while the sentence of death was passed upon Jones at the all term ot tbe Criminal Court, in 1886.. The case was taken up on appeal and the act of tbe lower Court was sustained. Tbe question now arises Is the law-! pass ed after sentence had been pronounced upon which the warrant of execution was issued, ex post facto in its nature? The Supreme Court have the matter under consideration and it remains for that body to determine whether tbe warrant of tbe Governor shall be exe cuted or that the prisoner shall be re sentenced at tbe net term of the Criminal Court. fn the meantime prominent oolored men are making strenuous exertions to induce the Gov ernor to commute the sentence to im prisonment for life.
