The decision of the New Jersey Court of Errors and Appeals sus" taining the high license and local option law was evidently a surprise to the liquor dealers of the State but it is in line with substantially all the adjudication of the country on the SHbject of the power of Leg islatures to regulate and restrict the liquor traffic. That power is prac tically unlimited as to the methods to be used in ' effecting regulation. The New Jersey law was contested mainly on technical points. It was claimed that the- title did . not ex press the,true intent of the Act, be cause it designated it as one to reg ulate, whereas it might also prohi bit, bat it' was held that regulation might include the,, prohibition of sales in small quantitie's, or at cer tain times, or to certain persons. Then it was claimed that the" power to prohibit could not be delegated to the voters of a county or a town, but the Court held that the prohibi tion was involved in the law itself if no licenses were granted, and that the power to decide whether licenses should be granted" could be dele gated by local authorities or to the voters themselves. - Again it is con tended that this law was special legislation, inasmuch as it might ef fect prohibition in one county while license prevailed in another, but this position was overthrown by the declaration that the law applies to all counties alike and delegates the same powers to all. That it might be exercised differently in one from what it was in another did not make the special legislation.
