We nave already seen wnat our
members of Congress have accoin
nlished in chantrinyr the internal
revenue laws in reprard to tobacco.
In the matter o:' distillinpr brandy
and whiskey, it lias been muchmore
difficult to pret the internal revenue
system modified than in that relat
inpr to tobacco, because,amonpr other
reasons, the Republican administra
tion said at first that if the law was
chanpred ever so little there would
be no chance to convict any man, no
matter how truiltv. 11ns idea was
so much repeated that at last it
came to be believed, and althouprh
our Representatives would arprue
and appeal for a change in the law,
the answer would come back that it
is impossible to chanpre the law
without throwing open, the doors
for every guilty man to walk
through.

been done.
The House Judiciary Committee re
ported a bill (Mr. John Henderson's
bill) on January 25th, 1888, to amend
the internal revenue laws so that
there shall be no minimum limit to
punishment (of course themaximum
limit was preserved), but in trivial
cases the judge may impose such
punishment as he thinks proper;
that no warrant should be issued on
information and belief unless the
oath was made by the collector or
his deputy; that all warrants shall
be returnable hi the county where
issued, if a judicial officer resides
therein, otherwise in the nearest
county where such an officer resides?
and such officer shall have exclusive
authority to hear the preliminary
examination; that the judges may
remove United States commission
ers; that the commissioner of inter
nal revenue, with the approval of
the Secretary of the Treasury may
exempt distillers of brandy made ex
clusively from apples, peaches,
grapes, or other fruits, except as to
the tax thereon; that the Secretary
of the Treasury may exempt all dis
tilleries which mash-less than twenty-live
bushels of grain per day, ex
cept as to the payment of the tax,
which said tax shall then be levied
and collected on the capacity of said
distilleries; and said distilleries may
then be run and operated without
storekeepers or "storekeepers and
gauge rs"; that the commissioner of
the internal revenue system may
compromise cases and remit lines
and penalties; that stills of .less ca
pacity than 150 gallons, etc., shall
not be cutup and destroyed; and
that whenever it may appear to the
judge that the health of a prisoner
is endangered, he may make snch
provision in the matter as may be
proper. On February 7th the bill
was passed. Now, these provisions
strike at the very root of some of
the great abuses which make the in
ternal revenue system so odious.
But although our Jforth Carolina
members had passed that bill
through the House they feared it
might fail in the Senate, and so
when the Mills bill, reducing taxes,
was being matured phey worked un
remittingly and secured the engraft
mentinto that bill of exactly the
same provisions. ' ,
Nor did they stop there, for, fear
ing that bill roifjhtalso fail, on June
22d, when the House was consider-

, the clause was reached making ap
propriatlons for fees of United States
: commissioners, etc., they had it so
aiuended that ho part of this money
should be paid in fees to any coiu-
imissioner, marshal or clerk for any
i warrant issued or arrest made, or
j other fees in prosecutions, r unless
I the prosecution had been commenc
ed upon a sworn, complaint setting
forth' the facts constituting the of
fence and alleging jthem to be with
in the personal knowledge of the
affiant, except where the affidavit is
made by the collector or deputy col
lector of internal revenue. k
This amendment was not made,
however, until afler sharp debate
and strenuous opposition. : It was a
great victory, the amendment being
a most jmportant one, as it will
have a great, effect in stopping' those
frivolous prosecutions 'which have
so long been the curse of the people
and which have made the internal
revenue system so odious to all. It
has robbed the system of the very
thing which has so harassed the
people. In this work Mr. Johnston,
who otierea tne amendment, uau
the cordial" co-operation of Messrs.
Cowles, Henderson and our other
North Carolina Democratic mem
bers all honor to them.
But that did not end their efforts.
When the Mills bill came up they of
fered amendments repealing the in:
ternal revenue svstem outright;
these, however, they could not car
rv through
Amendments were offered by our
North Carolina Democrats to repeal
the tax on fruit brandy, but these
also they failed to get through, tne
reason assigned being that to repeal
the tax on fruit brandy would make
it. impossible to convict any man of
violating the law in the matter of
distilling whiskey, as whiskey mix
ed with a little fruit, brandy would
be represented and sold as pure fruit
brandy.
Thus we see that our Democrats
have at last been able to accomplish
something. The tobacco part of the
internal revenue system was grad
ually lightened by them until at
length it has been virtually wiped
out of existence, and the whiskey
part, has been greatly improved.
EJThe House has passed in three dif
ferent bills . an amendment to the
law wiping'out these frivolous pros
ecutions that so harassed and an
noyed our people; and it has passed
in two different bills those impor
tant provisions modifying the inter
nal revenue law in particulars that
will relieve it of much of its harsh
ness and remove those features
which have been so oppressive. It
remains with the Republican Senate
to say whether the people shall have
that relief. Our Democratic mem
bers have done their full duty, and
the people should recognize in them
faithful servants.
In this connection it must be re
membered that John Nichols voted
against the Mills bill, and that
Brower has been repudiated, by his
party because he voted for it.

The disposition of the Surplus in
the U. S. Treasury engages the at
tention of our Statesmen, but a more
vital question has our attention,
and that is the reduction of the Sur
