The Supreme Court of Pennsyiva nia on Friday rendered a remark able decision relative to the trial of persons charcred with murder. It was decided that a disagreement of the jury in murder trials is equiva" ent to an acquittal, and that the accused person cannot be again ar" raigned for trial after one jury has ailed to agree. The ground for the decision is the Constitution, which says that a man cannot more than once be put in jeopardy of "life and imb." The Supreme Court in its decision declares that the Constitu tion is very clear on the point raised, and this fact, says a Phila delphia paper, makes it remarkable that the point was never raised be- ore. Many men have, it adds, beep tried for murder a second time, con victed and hanged,. and it would be interesting to know how many have been hanged unconstitutionally in Pennsylvania. The decision, it con tinues, will have the effect of releas ing several men-who are now await ing trial after juries in their first trials had disagreed.
