Court, in a case to day testing the validity 6f panel 'of a jury drawn of voters or tax payers, irrespeeilyeof color, de crided that, although the act of Congress of 1840 required the jurors; to be;drawn as prescribed by the Legislature of each respective State, yet that this must be construed in reference to the changes created by the war.! -'lie held ; that1 Congress, as now constituted; was. the legal Congress of the whple country ; that the Reconstruction Act of Congress conferred suffrage on the negro and was the provisional constitution and law of the State. He held that President Johnson had no power to restore any seceding State to the Union. He says : 1 say it with a grave sense of respon sibility, it was not competent for the President, by any act of his, to bind Congress and restore the State to the Union and connect it with it, by Constitutional ligaments and relations. . He held there was no legal government or State Constitu tion in South Carolina,1 and under the existing provisional government the reconstruction acts of Congress were the supreme law and the Consti- luliuu ui me oiatej ne says it mere was any Constitution in South Carolina, or any - legal State Government, then the j act of 1810, com manding the Judge to accept as jurors alone those who are voters under tho .
