Washington. Feb. 17. The Supreme Court to-day overuled the mo- tion. heretofore made, to dismiss the appeal in the McArdle case, for want of jurisdiction. The case will therefore come up for argu ment on its merits, as previously arranged, on the first Monday of March. 4, OUR NIGHT REPORTS. From Washlncton. Wasuinoton, Feb. 17. Grn. 8tcadman has resigned the Mew Or leans Internal Revenue Collectorihip, to take effect the 15th of May. ,, Sumner presented a petition from citizens of Ma&sachusetU praying the abolition of tbe Preaideuti.il oflice as dangerous to the Kei public. Trumbull's bill was Introduced to-day, de fining the Jurisdiction of Courts of the United i States in effect as follows : It provides that all Courts of tbe United States shall be bound by the acts of Congress on political Questions, and that it rests witb Congress to determine what government is the established one in any State, and it is declared that no civil JState governments exist J in the excluded States ot the South, and no so-called civil State governments in such States shall be recognized by either the Executive or Judicial power of the United States until Congress shall so provide, or until such State is represented in the Congress of the United States. The Reconstruction acts are declared political in their character, the propriety or validity of which no Judicial tribuual is competent to question ; and the Supreme Court of the U. S. is hereby prohibited from taking jurisdiction of any case growiug out of the execution of st id, acts in either of said States until such State shall be represented, etc., etc.; and such now pending before that Court shall be dis missed, and all acts authorizing an appeal to the writ of error, habeas corpus or other pro ceeding, to bring before said Court for review any case, civil or criminal, arising out of the execution of said Reconstruction acts, are hereby repealed. ' Senator Sherman says the General will not accept either tbe Brevet appointment or the command of the new Department, and if the President declines to relieve him from the lat ter, he will promptly tender his resignation. FORTIETH CONGRESS. SECOND SESSION. Washington, Feb. 17. Hous. --Bingham introduced the following, which was referred to the Reconstruction Com mittee: ' 1 " Whereas, A large majority of the votes given at an election held on tbe 5th day of .February, 18o8, were for the Constitution presented by the Convention of the people of the State of Alabama and ichereas certain citizens within said State refused to vote, with the intent thereby to defeat the efforts of the friends of the Uuion to restore said State to its proper relation .to the Union; therefore, ' Be it enacted, Ac, That the Legislature elect under the new Constitution of Alabama, be convened at the Capital of said State as soon as practicable, by order of the U.. S. Military Commander within said State of Alabama, and upon the ratification by the said Legislature of the 14th article of the amendment to the Con stitution of the United States proposed by the thirty-ninth Congress, and the establishment by law of Impartial suffrage, within said State, aa' authorized by said Constitution of Alabama, the said State shall be admitted to representa tion in the Congress of the United States in accordance with the - law of th United States. , ..,.-, i Nothing else important was presented under tbe regular calL , The House resumed the appropriation bill.
