J Honorable Secretary of War, Washington, D. C.: Sir : The question of electing Senators to tho Congress of the United States bv tbe Lezisla ture which is to assemble in this city, on 5th proximo, is one of great present interest in the State, and many applications have been made for a decision upon that point Tho sub ject appears to be so free from difficulty that I have not hesitated to express tbe opinion, un officially, that the election of Senators was au thorized and necessary to complete recon struction, and was prescribed by the law of July 25, 1865; buttbatit was not proper for me to make a decision upon a question that addressed itself so directly to the discretion of the Legislature after it was organized. There are many, however, who are of opin ion that this action is in some way restrained by the opinion of tbe Attorney General of Au gust 28th, 1869,and I have the honor to reqnest that the question, Whether the Legislature ot this State is authorized to elect Senators of the United States, at tbe session which com mences on the 5tli of next month, may be sub mitted to the Attorney General for his opin ion. ., , j, "Very respectfully, sir, Your obedient servant, Signed Ed. J Sir : I have the honor to acknowledge the receipt of your letter of this dute, referring to me, for my opinion, a letter addressed to the Secretary of War by General Canby, dated September 24tb, 1860, which asks whether the Legislature of Virginia is authorized to elect Senators of the United States at the session -which commences on the 5th of next month, and desires that that question may be sub mitted to the Attorney General for his opin ion. The general views which I entertain of the functions of tbe Legislature of Virginia, elected la pursuance of tbe act of Congress of August 10th, 1869, have been already fully in dicated in au opinion transmitted to the Sec retary of War, under date of August 28th, 1809, T 4smn tr t.hft (nnrlnftinn that, thu mom Km-. rf the Legislature were not requted to take tbe oath referred to in section 9 of the statute of July 19th, 1867, in order to qualify them to act a anch members: that it was com Detent on. Apr thn Inw for the l.PCrislAtnrp. tr meet nrfran. ize and do whatever was required or allowed ' by tne acts oi congress as preliminary to the reconstruction of the State, but that it was not competent for them to undertake to enact laws or otherwise assume any of the functions of the irovernmentof tho State if organized with out taking the oath above referred to, or if any of its, members could not or did not take that oath upon a careful consideration. I am now of opinion that the election of Senators, like voting npon the Fourteenth and fifteenth Amendments to the Constitution of tbe United States, Is a part of tbe action contemplated by Congress as I reliminarv to a restoration of the "Statu to its full relation to the Government of the United States as one of the States of the Union. The Senators thus elected would have no power or authority until the Senate of the United States shonld have passed npon tbe vaiiauy oi tueir action ana aamiuea mem as members of that body. Under tbe act of April 10th, 189, the elec tion of members of the House of Representa tives was permitted, and has taken place, and when Consrress comes to act upon tho whole . question of the reconstruction of. the State, it - wouia seem equauy proper tnat the members elected to both branches of the National Lesris la ture should present themselves and bo ready loraamission to seats in tne respective nouses. The election of Senators does not seem to me to transcend the action which comes within the limited and qualified purposes requisite to reconstruction, but rather to be essential to the completion of that action, and I think that tne military commander should not Interfere wun or prevent it. . t.
