The conflict of authority case has been disposed of for the present,. Tbe Commissioner's Court met at 10 o'clock yesterday morning, when Commissioner Rutherford rendered his decision in tbe 'case. The defendants Burnet, Woodford, Van Amringe, Nash and Hill were required to give security in the sum of $500 for their appearance be fore the next term of the U. . S. District Court, to be held in this city ou tbe first Monday in Mav next, and the other de fendants were discharged. This ends tha farce for the present, as far as the prelim inary examination is concerned, though some are inquisitive enough to wish to know why all were . not served alike. There is' also some curiosity expressed as to what action will be taken with regard to the property in dispute, during tbe in terval belween this and the . assembling of the Court. Sheriff Schenck will be here in a few days, and probably some new de velopments, will then be made. '4 THor Shalt Not Steal." We learn that some person or persons, who do not pay much regard to the re quirements" of . the ten commandments, have .been depredating . upon property stored tinder the shed on the wharf -of Messrs. A: B.' Shepperson' & Co." " Some of them recently opened a bag of coffee and abstracted therefrom . some seventy or eighty pounds of that article. . These dep redations 1 have been' continued at slight Intervals for sometime past, and on Friday night last, we are - informed, they made quite a haul. We learn that a little boy, a pupil -in "the Hemingway School, by the name of John Silver, had his eye accidentally put out, yesterday, by a slung shot'in the hands of one of his playmates. Harbor Master's Fees. -At a meeting of the- Board of Commissioners of Navigation and Pilotage, held on Tues day last. Silas N. Martin Chairman! and B. G. Bates and James H. Chadbourn be ing present, a letter from the Chairman to N. Sargent, Commissioner of Customs, in relation to Harbor Masters' fees,' and the answer to the same, were presented. We were furnished with the whole correspon dence, but its length, and tbe lateness of the hour .; last eveniog when it came to hand, compels us to give only a brief syn opsis. . : . ' r The letter of Mr. Martin to the Pom missioner refers to the late correspondence of that official with the Collectors of sev eral cities of the United States regarding the collecting of. Harbor. Masters' fees, and to tbs refusal of many of our merch ants and agents of vessels to pay the usual fee of three dollars ; and then asks the question, if, under he decision quoted in the correspondence referred to, the State of North Carolina is powerless to enforce the collection of the said fees, and also, if it be illegal to collect the Harbor Mas ters' tee, if it is not equally so to collect pilotage. To which the Commissioner, in bis reply, after referring to the decision quoted in the correspondence alluded to in the outset, declaring the collection of the said fee unconstitutional and illegal, says : I know of no way, therefore, of enforcing, legally, their collection;" and declares, in answer to the second question, that the collection of pilotage, under the decision of the Courts, is not equally il legal. He also intimates that the harbor regulations are a matter of city police, and the expense should be borne by the city. ' The Board then ordered that from and after the 20th inst, no pilots shall be . al lowed to run as regular pilots on any vessel except they ship as first mate, as re quired by Regulations No. 5, of the Rules and Regulations of this port, revised Sept. 18, 1868; and that when a full branch pilot conforms to tbe above regulations he shall be granted leave of absence for a term not exceeding three months, at any one time, and that for such leave of ab sence he shall pay the clerk two dollars for the same, for tbe use of the Board. It was also ordered that when the mas ter, agent or consignee of vessels arriving at this port shall voluntarily pay three dollars to tbe Harbor Master, they may command at all times bis services while tbey remain in port, but if they refuse, then the fee is fixed at Five Dollar, for the first visit, and Two Dollars and Fifty. Cents for. each subsequent visit, which shall be collected as provided in Revised Code, Chapter 3, page 461. The Cape Fear Academy. An interesting incident of the approaching Fair will be the parade and drill at the Fair grounds of the cadets of this insti tution. - Our country friends will have an opportunity of seeing'the results of Gen. Colston's labors to establish in this city a first-class educational institution, worthy of the patronage of tbe whole State.' The Academy is already an established institution, and one which Wilmington regards with unspeakable ' pride. The high reputation earned by Gen. Colston in bis fifteen years' . experience as a ' Pro fessor of tbe Virginia Military stitute has been amply vindicated by the brilliant success which has attended his labors here. ' Though hardly a year has elapsed since its establishment, Cape Fear Acad emy already presents an educational stan dard superior to that ot. many colleges. The boys whom Geneial Colston is now training will in a few years vindicate the judicious discipline and admirable system of instruction, which he has already ma tured. , J i z ;:- -;;:ur: ! " The Academy now ; embraces seventy five cadets,with frequent accessions, which will probably make the aggregate attend ance nearly one hundred,, before the end of the session. Savs the Weldon News : Judga Watts adjourned the Court for this coun ty on Wednesday ' evening having gone over the State docket since Monday. Of this extreme haste and its results w will allude to a moment. We have ,but two Superior Courts a year under existing affairs, and as a consequence an immense amount of business comes before them, while in the meantime, in criminal cases, the county js at the expense of feeding, its prisoners.
