Our streets were enlivened yesterday by a pnriulc of the Cadets of the Cape Fear Academy, headed by the splendid band belonging to LaRue's Minstrels, under the direction of Mr. O. K. Axtell. The Ca dets, as usual, made a very handsome dis play, and the evidences oi pruficitney in the manual of arias as exhibited on Market-street,' together" with thc'accuracy and precision with which they executed the various uianccvres required ot them, was alike creditable to themselves mid to the institution to which they are- attach ed.-i-Thcy are a uobte- set of boys, and Gen. Colston may well be proud of h protege. Said Court shall continue to be held at the City Hall, in the City of Wil mington, every day (Sundays and holi days excepted) for at least two hours, when the business shall so require, and the Marshal of the city shall be executive officer of said Court; he shall attend the same in person, or by deputy, open and adjourn its sittings and execute all its processes and orders, and shall be entitled to receive the same fees as the Sheriff is allowed for similar services; the Clerk thereof shall be appointed by the Mayor and Aldermen of the City ; he shall issue the process of the Court, and keep the minutes, records and archives of the same. He shall give such bond as the Mayor and Aldermen shall direct and approve ; such bond shall be made payable to the City of Wilmington, but any person en damaged may sue thereon. Sec. 5. r'jCy party convicted shall pay cost in all tfs, and if the party charged be acquitted, the complainant may be adjudged to pay the same, and be impris oned tor the nonpayment thereof, it the prosecution shall be deemed frivolous, and malicious. In all cases before said Court, the same fees and costs , only shall be taxed, as are allowed by law for like ser vices in tho Justices Court, and all fines, forfeitures, and penalties recovered and adjudged shall and may be collected and enforced as City fines and penalties are now collected, and enforced by law, and are then to be paid iato the City Treasury. The compensation ot the Clerk and Mar shal, shall be annually ascertained and established by the Mayor and Aldermen of said City. The Judge of said Court in addition to the' annual salary of one thous and dollars, and in lieu of the compensa tion heretofore required tor him from the County of New Hanover, shall be entitled in every case to the fees of Justice of Peace, and the same shall be ossertained first Monday in January, 1870, out of City Treasury, and the County ailowa and paid bim quarterly, beginning on the tne ance snail tnereuponceasc.
