It having been represented to the Depart ment that the use of a lighted torch by sailing vessels on the approach of a steamer daring the night time, as required by section 70 of the Act of Feb. 28, 1871, endangers the safety of siieh vessels wheu laden with wood, hay, or other combustible material, the Collectors of Customs and others are- instructed that when ever it is apparent that the use of a torch : or flaming light would endanger the safety of tbe class of vessels referredto, and that a different light may substantially answer tbe purpose of the Jaw, a large globe light may" be used instead of ttlightedf torch : " Provided, however, that such globe light be waved or swing to and fro in each a manner as to distinguish' it from a permanent light.
