Who Is He?
The following paragraph has been going the
runnels of the press for several months :
" The tea plant may yet be naturalized in
this country. A gentleman in Wilmington,
N. C, has raised the plants and' cured tea
which he claims c innot be excelled in flavor
by the imported article." ' '
The old saw about going from home to get
the news is well illustrated in this paaragraph ;
for, here in Wilmington, it has a smell
freshness that surpasses the choicest Imperial;
or Young Hyson. Who is the gentleman re
ferred to ? Possibly, we may be in error iu
guessing that it is Mr. James M. Smith, of
Fayetteyille ; but if we ae, we are none the
less anxious tb know who 'the gentleman
in Wilmington.' , ' -

Important Decision. '
, As the United States District Court opens
here next Monday; the following' decision of
Judge Brooks, which we take from 'the New-
bern Timesy will be read with interest : :
Judge Brooks on Wednesday, while de
livering an opinion in relation to d motion
made that a violator of a revenue law whose
evidence had convicted another man, and who
became a witness only upon the assurance
given by some revenue officers that he would
not be charged with, or tried for any offense,
said that cases had' come uuder bis observa
tion where revenue officers, for the purpose
of causing men to violate the Internal Revenue
Law, had entrapped men by purchasing ( from
them goods necessary to prove the violation
of the law; His Honor said that," in his opin
ion, when a United States officer, for the pur
pose of trapping a man into a violation of the
revenue law, purchased from him goods which
he knew were sold in violation of the law, he
becomes particeps criminis, and if not indicta
ble should be.
" His Honor also held that where govern
ment officers use a person charged with a vio
lation of the law, as a material witness, and
when by his testimony he criminates himself
it would be neither fair nor proper to indict or
punish him."

" Col." George M. Arnold (slightly color ed)
late of this city, seems to be creating a sensa
tion in Virginia. He is thus referred to in the
Richmond Hhig:
"Orator Arnold. (colored) brings the State
Uournalb&d news from Buckingham. He re
ports that the Hon. Frank Moss will be defeat
ed for the Senate, on accoun t of his advocacy
of mixed schools.' Other accounts represent
him as crazy ' and going 1 nto the wilderness
and holding convtrse with Angels, who as
sure him of re-election and a crown of glory."

George M. Arnold, the Radical colored ora
tor ' from prth Carolina, contradicting the
statement that he got away very quick from
Buckingham county, fearing personal violence
from Hon.' Frank Moss," the Radical ; hippo
potamus.! Arnold admits, however, that the
meeting between Moss and himself was cool
and distant.' He says :,

the following suggestion t A Grand State
Conventiorl of the ' Conservative party
should assemble early next May, and put
forth candidates for t State . offices, and

most counties meetings could be held
during the spring: courts, and these courts
are about over in' May. That month is
pleasant and not so busy a farming season
as the remainder of the time up to the
election will be. Members of Legislature
will be back at home (we hope), and then
we move for a rousing State Convention
early in May. We have had too much of
ring and clique platforms, and self-appointed
organizations. Let the people
come forth and lay down the issues in
their plain, sensible way. ' Caucuses will
do in their place, but we need a rallying
of the masses on the great issues to be
decided next August and November.
