Solvent Credits not to be Taxed. The following opinion in the case of Pullen v. the city of Raleigh, de livered by Judge Pearson in the Su- I preme Court yesterday, decides that I money credits, investments in bonds, stocks, fcc, the? ' property mentioned in the first clanse of Section 3, Article 5 of the Constitution of the State, is not taxable by municipal corporations. The following is the opinion: " ' 'The power of the city authorities to tax-debts and securities for money hold by the citizens depends upon the , charter. That instrument enumerates nomi natim the subjects of taxation eight in number, begiuning with real estate situated in the city, ending with en croachments ou the streets by porches, fcc. But no one of these eight spe cifications' uses any word which, by the utmost stress of construction, can be made to embrace " debts and se curities for money." The word property,' about which so much was said in the argument, is not used in that enumeration of the subjects of taxation: In regard to that word, by the by, we see that the Constitution does not -make it in clude money credits, investments in bonds kc. Ileal and personal property is used in a sense to exclude audi 'credits and investment's." Art. .5. Section 3. We concur with his Honor for the reasons given by him. Judgment affirmed. " Narrow Escapes. ' Yesterday morning, about half past 9 o'clock, fire was discovered under the roof inside the coppersmith shop in the Foun dry yard of Messrs. Hart & Bailey. It was attaining considerable headway ( when dis covered, but the yard engine was' brought into requisition and the flames were speedi ly extinguished. About two hours later flames were dis covered bulging out at tbe side of the kitchen in the rear of the residence of Mr. Jos. II. Neff, only a few feet from the cop persmith shop in which the previous fire occurred. The discovery was made by some of the employees of Messrs. Hart & Bailey, who soon bad two streams on the fire, one from the steam and the other from the hand-pump, when the flames were promptly extinguished. -. - The kitchen alluded to is not much used. and it is supposed that the fire originated from a deposit of hot ashes from a stove. Fortunately, there was no occasion for an alarm to be sounded in either instance, though it is likely there would have been a big excitement had the facts been known on the streets. - On His Travels. The Raleigh Sentinel of yesterday has the following in reference to James Kennedy, the old man who reported that he was knocked down and robbed on the road near this city, on Friday last: "A man, ap parently 60 years of age, came to our city Monday, (and we know how very cold that day was) minus a coat, and without a cent. He says he was knocked down and robbed of his money and coat a few days since; at or near North East on the Wilmington & Weldon road. He hails from Rochester, N. .Y.; heleays he l a cigaf jm4Xer,; and would do any honorable work for a living in- his distressed condition. ' Some kind hearted people here clothed him and pro cured for him a free passage as far as Wel don! The man told the same tale in Wil mington a few days ago, as our readers may rememoer. ll tne people inereueiieveu it, they surely must have helped the poor f el low, and he has been imposing upon our people. If they did not believe it, then the probability is be is an impostor." Another Case of Longevity. ; A colored woman, by the name of Sarah Foy, died at the County Poor House on I Wednesday who bad attained to the gooa 0d 8g0 Qf no years. Sho was a native of I viro-inia. but had been in this county for a I ' r T numbCr of years. A gentleman who con- versed with ber about a week or two fore she died, says she informed lum tnat sne could remember distinctly when her young master left home to join , bis fortunes with the army, under Gen. Washington in the war of the Revolution. She also stated that she remembered having seen Wash ington, Lafayette and Lord Corn wallis near the close of the war. She died from old age. Falson's. It is a little singular that Faison's, that flourishing little village on the Wilmington and Weldon Railroad, with ten stores and others in prospective, should be without a lintel nr an eat in ir house. We are led to these reflections by hearing the experience of two Wilmingtonians who happened there a few days jince and were unable to obtain anything to satisfy the cravings of their ap petites, which had been sharpened by travel and exercise, except by applying at a pri vate house. Vree Schools In New Hanover and the ttr of Wilmington. The Board of Education met at the office of the Chairman, S. N. Martin, Esq., last evening, all the members being present. It was ordered that H. B! Blake, A. R. 31ack and O. Gt. Parsley be and are hereby appointed County Examiners, in and for the county of New Hanover, who shall be styled "The Board of Examiners," and serve for one year and until their successsors shall be appointed. Ordered further that the Clerk of this Board send the names of the Board of Ex- nminers and their Post Office address to the Superintendent of Public Instruction. It was ordered further that the school districts" in the county of New Hanover shall be the same as the townships, and that each township shall be known as a Free School District and numbered in alphabeti cal order from 1 to 13. It was ordered that the Clerk of this Board notify .all Jeachers now engaged in teaching free schools under the provisions of the school law of 1872, and the School Committees of the several Townships in the county of New Hanover, of the change made in the school law by act of the Gen eral Assembly, ratified January 26th, 1873, and that all free schools now in operation cease. Ordered further, that teachers engaged .under the law of 1872 present their claims for compensation immediately upon receipt of said notice. Ordered further, that all School Commit tees are by this order authorized to con tinue any schools within their jurisdiction, under the provisions of the Act of General Assembly, . session 1872-73, where no school has been taught for four months prior to the notice directed by this order. Ordered that after tbe payment of the teachers, what amount may be due them for services rendered up to their receipt of notice to discontinue the free schools under the act of . January 17th, 1372. there shall be made a distribution of the money on hand belonging to the school fund, accord ing to the provisions of the act of General Assembly ratified January 26th, 1873, that is to say, in the ratio of the number of school children to the sum to be divided, for the support of free schools for the year beginning July 1st, 1873, and ending June 30th, 1874. And it was ordered further, that in the distribution as aforesaid, the amount de signed for the children of the colored race shall be stated and appropriated separ ately, and the funds belonging to one race shall not be used for tbe other race, said apportionment to be placed to the credit of the several Township School Committees whenever the same shall be required for disbursement according to law. Ordered further. That the Chairman be and is hereby authorized to prepare instruc tions and blanks for the nse of school com mittees and teachers, and distribute the same, in order that the new law and manner of procedure may be understood. Ordered that the Clerk of this Board notify the School Committees in each town ship to make their estimates for the pay ment of teachers and assistance required in obtaining sites and building school houses, as required by section 26 of the Act of General Assembly, ratified January 2Cth, 1873, said estimates to be made for the year beginning July 1st, 1873, and, ending June 80tb, 1874. It' is required that said esti mates be handed in by or before April 1st, 1873. It was ordered that the sum of two thou sand dollars be paid Over to the School Committee of the City of WUmington, or the City Treasurer, in'the discretion of the Chairman, out of the school money now in the hands of the County Treasurer, for the payment of teachers amounts due or which may become due, for services rendered and to be rendered before June 30th, 1878. It Was ordered that the Chairman be and is hereby authorized to procure the service of some competent person to serve the no tices, as required;by this Board, on the sev eral School Committees and; .Teachers, at such compensation as he may deem advisa ble. Meeting adjourned, subject to the call of the Chairman. .3 Election of Officers. At the regular meeting of Wilmington S. F. E. '" J '" ' ' A very fair audience, taking everything into consideration, assembled at the Opera House last night to witness this very enter taining and amusing exhibition, and we feel satisfied that none Came away disap pointed. The scenery descriptive of ' Erin's Green Isle" was very beautiful, and the characterizations, musical and dramatic in terludes were received with evident appre ciation by the audience. We regret to learn that in order to meet their engage-' ments ahead the company will only be able to give two evening entertainments, and will therefore not give any performance on Saturday -night. There will be a grand matinee, however, on Saturday afternoon, commencing at 3 o'clock. Go and see the Hibernicon to-night Local Dots. - The naval stores market is quite brisk just now. Mr. E. J. Hatcher, our quondam neigh bor of the Express office, was in the city yesterday. -The only case before the Mayor's Court yesterday morning was that of Robert Webb, charged with larceny, who was found not guilty. Rosanna Witherspoon has recovered her child, alleged to have been kidnapped by Maggie Little, both colored, and the latter has been discharged from custody. The Btrger Family Swiss Bell Ringers will perform at the Opera House in this city on Tuesday and Wednesday evenings, the 11th and 12th inst., as will be seen by an advertisement in another column. For once "Old Probabilities" has been guilty of a big mistake. He predicted cloudy weather and possibly rain for the South Atlantic coast yesterday, and here there was not a cloud visible during the entire day. Wilmington LTCenm Association. At a meeting of a number of gentlemen held at the rooms of the Wilmington Li brary Association last night,' for the pur pose of organizing a debating society, under the name and style of Lyceum Association, the meeting came to order by Mr. John J. Fowler being called to the Chair. On motion of Mr. Marsden Bellamy, Messrs. M. Cronly, Jr., andE. D. McBhenny were requested to act as Secretaries. A committee of five, composed of Messrs. R H. McKoy, M. Cronly, Jr., E. D. Mc- Ilhenny, Jno. J. Fowler and Wm. R Mo Koy were appointed to draft a Constitution and By-Laws.- On motion, an election of officers was entered - into, which resulted as follows: President, Marsden Bellamy; Vice Presi dent, John J. Peacock and Miss Allie Horton, daughter of Col. 8. P. Horton, were married by Rev. Mr. Thomp son in the Methodist church in Smithfield on the 27th February. The Hillsboro Recorder says: Mr. William Anderson killed last week a mile west of town, a wild turkey weighing 19 lbs, and Mr. Joseph Guess killed five of the same noble bird at one shot.
