Yesterday ' morning was " tlie lime set
for a hearing jn the cases of 'the parties al
leged to have committed the assault upon
J. IL Carraway, the eolored barber, some
weeks since, upon the public streets, and
which came .near resulting in his death.'
The names of the accused were' John
C.) wan, Samuel Browu,' Jerry 'Forbes and
Henry Bradley. . George L. Mabson appear
ied as prosecuting attorney; Adam Empie,
Esq., for John Cowan, and John L. Holmes,
Esq., for Jerry Forbes.
J. H. Carraway was the first witness f
sworn, and nis testimony was positive as
to the identity of John Cowan as one of
the parties who made the attack upon him.
He knew him well, saw his face distinctly
and was certain that he wasthe man. Said
one of them struck him and knocked him
down, while; the other jumped upon his
back, crushed him down and run his hand
in1g his pocket and got a bundle of cigars,
when the police came to his relief.
Joseph Cutlar, policeman, swore that as
he ran to the scene of the outrage he saw
two men running from that direction down
towards Fifth street. Found Carraway suf
fering severely from the blow and was sub'
8equently informed by the wounded man
that John Cowan was one of the men who
struck him; x He and' officer Martin after
wards found Cowan and arrested- him in a
shop near Water street " ." " " 4 " ;
E; F.5 Martin, policeman, swore that at 12
o'clock that night, -while on MaVket street,
between Sixth and Eighth streets, he heard
three whistles blow in different directions,
after which he heard the cry of murder,
and found Carraway on the ground. Car
raway afterwards said that Cowan had
struck him. The whistles he heard were
not the kind used by policemen. Said it
was a peculiar whistle, and that John Cowan
knew how to whistle It Said there was a
crowd of men in -the city known at the
" suing gang," who have strings and blocks
to fool the country people. They have a
whistle to know each other.
Joshua Sill testified that - soon after
the outrage while he and : the police were
searching for Cowan, he saw Sam Brown
on Princess street," who said he was waiting
for Jerry Forbes. Carraway told him that
John Cowan struck him
Joe Jenkins swore that about 12 o'clock
on the night, of the assault he saw John
Cowan and 'Sam Brown together. They
were on Seventh street, going in the direc
tion of Market. He knew them well and
spoke to Cowan. Shortly afterwards he
heard a cry. He itentified Brown as the
man who was with Cowan
Other witnesses were examined, bat no
new facts of importance were elicited.
The Court ordered that Jerry Forbes and
Henry Bradly be discharged, and that John
Cowan " and ' Samuel Brown give '' seen-
rityin the sum of $1,000 each for their
appearance at Court, .in -default of whicli
they were committed to jail.

at Culpeper Locks, on the Dismal
Swamp canal, in Camden county, N.C., on
