suitable tools for future operations in his

' Yesterday morning the trial of Elizabeth
Carter, charged with being -partieeps:
ni to the murder of Willie Carter, her step-
sen, in August last, 'was 'Commenced in the
Superior Conrt His Honor, JudgeBCloud,
presiding. ; The prisoner, who was dressed
in deep black, with a vail of the same color
oyer her face, was seated with her 'counsel,
Messrs. Adam Empie isnd John L. Holmes,
her husband also occupying a seat by her
side.: Solicitor Edward Cantwell represent
ed the State.
After the arraignment of the prisoner in
due form of law, the jury were drawn, sworn

,The Court then took a recess until after
dinner, the jury la the meantime being
placed in charge of an officer
On the reassemblihg of Court, Dr. W.W.
Lane was called by the Stale to testify as
to the condition of the body,after which
Alvoid Van Amringeand. Marion Hollister
were examined asto facts connected with
the finding of the body.
The question pending at the adjournment
was upon the admissability of the declara
tions of the deceased. Mrs. Wiggs, Mrs.
Roberts, and other witnesses for the State
testified to severe bruises and welts upon
the back and sides and thighs of the de
ceased child, at various times, from ten
months to a week before the homicide. The
State offered to show that these bruises
and -: Whippings were done ' by the
accused. In fact, that the accused
was .habitually cruel to deceased,: the pur
pose being to show her connection with the
murder, and the condition - of her- feeling
towards him, by his declarations pade at
the time the bruises were discovered. Also
to prove by the declarations of the deceased
that Mrs. Carter had a motive in desiring
his murder. The case of the State vs. Har.
riss (63d N. C.) was cited on behalf of the
State by Solicitor Cantwell, and commented
on. . - i
Mr. Empie, for the defense, replied,' insist
ing that its admission would be a violation
of fundamental principles. That these dec
larations were made in the absence of the ac
cused, when she had no opportunity for
cross-examination or contradiction.
His Honor reserved his opinion.
The Court then took a recess until this
morning.
On the reassembling of Court, fcefore the
trial of the above case was commenced, ins
the case of the State rs. Julius Faarborgj
indicted for arresting three seamen in South
Carolina under a magistrate's warrant, his:
submission was, on motion, stricken out,,
and the cause set for a hearing anew, '' Mr.
Rumley, who Is IT. S. Collector for this port;
having, it appears, authorized the arrest un
der the act of the 7th of June, 1872. The
Solicitor moved for a judgment notwith
standing the act, on the ground that the ar
rest was not made by "the master, mate
consignee or shipping commissioner," as
required by the 53d section of that law, but
by Julius Faarborg, the defendant, who was
not i an officer or even a citizen, and
had no warrant He. said that
it was . monstrous to '-contend - thai.
Congress had power : to authorize the Col
lector to make an 'arrest "in another State
without warrant under his hand and seal,
and that in fact Congress had not done or
attempted any such ..thing.. He admit
ted, however, as we understand, that un
der the act in question, the Commissioner
under that law had power to issue his war
rants any part of" the, 'United States, and
was' not required to apply io the local magis
trates for assistance, as formerly. This is
important news to our seafaring friends. It
may be well to add that we collected from
the argument that a Commissioners' arrest
was void, however, unless the prisoner was
carried "before a Magistrate's Court in 24
hours, or a shorter time, and 'that if the
arrest should turn oiit to he improper the
master, . mate, U. S. Collector; &c ; have
each subjected themselves to a penalty of
one hundred dollars, besides the ordinary
penalties for assault and battery. - This also,
we suppose, will be news td this, class of
our readers. "
