Chicago, Aug. 10, In the Circuit Court, this afternoon, Judge Williams rendered decision in the famous Cheney-Whitehouse case. Application was 'made to Judge Williams last Spring, by counsel for the Whitehouse side of the con troversy, for an injunction restraining Rev. Unas. xi. L-neney irom preacmng in jurist church and the organization from further use of the church property. The case was argued for several days and was taken under advisement by the Judge. The court now decides that the objections to the form of the original bill were not well taken and are therefore overruled. This decision em bodies the following points: That the prop erty, although origiually taken in the name . . . t e i i of all who should be attached to the dis cipline and worship of the Proiestaht Epis copal church; that the property was held for the benefit of; the Protestant Episcopal Church and not for the Lbw Church party; that all churches in the United States are regarded in law only as voluntary societies, and the laws and rules of church organiza tions are regarded as stipulations existing between the parties; that, existing canons were stipulations by which Cheney agred to be tried; that the church court morenearly . resembles a court of arbitration than' a civil tribunal; and that by the law governing similar arbitrations, all arbitrators must be present at the hearing; that the court for the first trial of Mr. Cheney consisted of five assessors, and four only being present at the trial and final decision, it was not a court within the meaning of the church canon, and its action was void; that upon the second trial, the court had no jurisdic tion over the subject matter and its decision was also void ; that the Bishop had no power of sentence except in pursuance of the find ing of the church, court; and such finding being invalid, his sentences were also void ana uneney war never legauy cicposeu irum the ministry. - The bill is therefore dis missed for want of equity. movements of President Biaeaiahon . The game of cricket between the Sheffield (lab and twenty-two of the Americans was began. The Ameri cans won the toss,' "went to bat and made 132 in their first inning. The Englishmen then went in and when the game was sus pended for the day they had four wickets down, with 11 runs. ' During the afternoon the visitors gave an exhibition game of base-ball, in which the Bostons beat the Athletics by a score 19 to 8. The weather was fine and about 1,000 spectators were present. The Daily 2V eica says Marshal Bazaine has arrived at Spa and that Rouher has gone to the Chateau D'Areniinburg to consult with the Empress Eugenie. The Standarcti special dispatch from Madrid report that the Republican General Blanco has relieved Yittoria. He captured twenty cannons and several convoys from the Carlists, who retired from Estella. Gen. Seabollo has been recalled from the field to Madrid. !
