His testimony has been hereto fore given and referred to in these columns, and"not differing in any material point on this, occasion, we refrain from publishing it. During the examination of this witness, the counsel for the defendant was' necussu rily called away, and, the Court refusing to proceed in his absence, a long stoppage in the proceedings ; took place. , . The Court and spectators remained In silence during the entire time, and the wheels of govern- I ment were seemingly stopped. Nothing could be heard save the munching of , pea nuts and the harmonious' snores that pro ceeded from the nodding beads' ef several weary listeners who occupied the. ' corners of the room. l s ' -. The prisoner signified to the ' Court that he was willing for the examination to pro ceed (his counselhad sent a message to that effect as the testimony was being reduced to writing by an officer of the courtXbut the 'Squire refused, saying that the law was Otherwise, adding "This Court can't be bribed ,. In due time, however, the coun sel returned and the examination proceed' ed. At the conclusion of the testimony of Thomson, Ransom McMillan was called,: in whose testimony there was no material va riance, that we were able to observe,' from that previously given by him . Cowan, a witness for the State, being duly sworn, says: I "was on Princess street, near Water; heard a pistol fire; 1 walked ddwn JWater, across Market street; met a colored man standing at the gun; he asked. me what time it was; I 'told him aboui half -past 3. 1 1 proceeded on towards Gilbert's bar; on the corner of the alley I met Ransom McMillan and Albert Thoin son coming out; Ransom McMillan asked me if I heard that pistol fire; I told him I did and thought it was across thejrtver He also asked me who was that standing at the post, wbetheriit was. a policeman; I , told hfm ft wai a "colored man itanding there ; be observed-to me thai whoever sbot that pistol shot Jackson, the barkeeper, in the finger or somewhefeV I immediately hur ried in; asked Jackson if he was hurt badly; be told me not bad, and asked . me to take that man out there; I did so. Going out I met Ransom and Thomson coming back, who said that Charley Jackson was dead; I told him I reckoned not, that tbey were up all night drinking and playing around, and 1 thought be was asleep; I asked him' where he (the deceased) was; he said he wasfc& tUe' corner. - Burgess and ; myself passed on to the corner, thel colored man still standing there. I hope, however, the matter will rest until some future pe riod, when an Opportunity is afforded for a fairer musical test between the two bands than was enjoyed at Charlotte.
