The facts as developed by the evi dence were as follows: Frank went to Rogers' home to summon him to work on the road, when the latter ordered him off the premises, telling him he must leave im mediately, and that If he went about sums mooing white people be would get his head broken, or words to that i effect; whereupon Franks left without executing his summons, or designating what tools he should bring to work with. i Tbe Court held it was an assault, and dismissed tbe case on the payment of the Costs. n ; ; " !
