Baltimore, December 30, 1881. Mr. W. H. Bernard, Wilmington, N. C. : Dear Sir : In your paper of the 29th ult. is a dispatch from here, giving the de cision of Judge Morris in the United States Court, of a suit involving a patent of Boy kin, Carmer & Co. on a formula for making a fertilizer adverse to their interest. In the telegram is this language : "A large interest was involved in the result of this suit." We do not see, possibly, how or when any one could or can have any in terest in the decision, other than the liti gants. Dealers in Fertilizers, who were not involved, had no more interest in the result than we or any other druggists have in dis solving any of the many patents now on recipes for making patent medicines. The case has been appealed. If the judges on the Supreme Court bench do not, like Judge Morris,, believe that formulas of agricultural chemicals are not patentable, then we are solid, and our case is elear. But if the opinion of the court shall sustain Judge Morris, then we will submit,: and will also ask, what are patents on medicinal formulas worthy The principel is the same: All such combinations are made of old remedies. If new combinations, with new results, show no evidence of novelty, then, of course,' all patents on medicines are worthless. However, this will inform our friends that we are still in business, and selling ' 'Home Fertilizer, " and the only place they can. get it. , If anj; who read this do not agree with me, let him try it.
