It. Pugh. a two-story- dwelling oh the east side of Eighth, between Market and Dock streets. The fire seems to hare originated in a rear room on the second floor, and is generally supposed to have. been caused by a defective flue, though the family say it may have been caused by Are from the grate Igniting a pile of kindling wood which had been placed in front of it by the servant in the dlnini room below j The family were awakened by the dense smoke which was filling the rooms aad threaten- " lag all of thexo with suffocation. ' A little daughter of Mr. Pugh. the first to awske, gave the alarm, which at tracted - the attention of some colored men passing, who immediately turned their at tention to removing the furniture ftom the bouse. Io the meantime the fire depart ment had arrived on the spot and quickly bad streams from a neighboring hydrant oa the burn ins: building, and so admirably waa everything worked that much of the building was saved, though badly damaged by water, and the adjoining residences of Mr. John Maunder on the north and Mr. David Pratt on the south aide, though only a few feet intervened, were not searched in the least, their fences were not damaged and Mr. Maunder's front garden was not injured. Nearly all "the furniture and clothing in the upper rooms of Mr. Pugh's house were destroyed, and much of that re moved from the building was damsged by the careless manner in wbicb it was han dled. Mr. Pugh. had insurance to the amount of $730 on his house, ia the Connecticut Insurance Company .represented by Messrs. W. L. 8mith & Co.. and $300 on his furni ture in the Wilmington Mutual. J. K. Of the cases on the civil Issue docket. 49 were continued over, 80 set for trial and 12 put on the mo tion docket. Yesterday the following cases were dis posed of: -. H. H, Kaaprowicz va. Edward Bryson and Adelia Bryson adgment against E. Bryson for $31.75; noS-suit as to Adelia Bryson. Gambel Manufacturing Company vs. 1st National Bank; judgment for $150 and costs. Estate of Geo. Myers va H. G. Banner man; judgment. The following cases are set for to day: W. B. McEoy vs. Tab Porter, rf. alt. W. C Farrow va J. A. Cloud, v L. N. & J. a Hopkins vs. A- J. Cot tlogbam. - W. P. Oldham va the Wilmington & Weldon Railroad Company. The question involved in this case was one of public in terest. Mr. Oldham sued the Railroad Company, for the loss of oats which bad been consigned to him from Chicago, and which were lost in transit. There was a condition la the bill of lading that the com pany should not be liable for losses sus tained on other i connecting lines. The plaintiff sought to make- the terminal com pany liable, as it: collected all the freight for the .different lines, but as the loss oc curred on the Baltimore fc Ohio Road the W. & W.'Compsny refused 'to 'pay .and; made a test case. The Court decided in fa vor of tbo defendant. Mr. Oldham was represented by Messrs. McRae & Strange, 'and the Wilmington & Weldon R. R. Co. by Messrs. Geo. Davis and Chas. M.
