At that time it waa ahown ia evidence that wbea the railroad company comtrocted its road where it now la, the northern limit of tbe city wae Campbell a tree I, aad tbe ccurt held that ioaaaauch as the defendant waa in dicted for tbe obatractioa of a street In th e city of Wilmington, aad inasmuch aa tbe railroad company had coaatracted ita road before the eztenaioa of the city limlta to their present boundaries, they were rot liable for obstructing a street in the city of Wilmington. Tbe present prosecution aad indictment against the defendant company are, founded a poo a totally different statement of facta. The indictment ia not for the obstruction of a street, bat for tbe obstruction of a common highway whkh eaisted long ante rior to tbe date of the charter of tbe de fendant company. The Solicitor aaya that the Supreme Court have intimated in the case first prose coted about the bridge that if the defendant company were required to keep op the bridge it would only be required to keep up such a bridge as waa sufficient to accommo date the travel alone the road ai it was b:fore the railroad wts constructed, and this would be a bridge about the pro portions and sixe aa now exists. This is not what is needed. There shook! be a bridge as broad as the street with a roadway and a aidewalk. ao that the cut can bo tranced by a roadway and paasway aufficient to accom modal the present demand of the public. Tbe Solicitor ay that be has had con ference with the attorney for tbe dXeed- aat company, with the Mayor of tbe city, and with somo tbe members of the Board of Audit aod Finance, from which be gathers that there is an understanding between the Board of Aldermen snd the railroad com. paay which will result in the building of a bndne such as above described. The rail road compaoy baa exprtajed iu wilhngncas to contribute liberally to Ibis end. Tbe Board of Aldermen have authorized the Mayor to tecure plana and make estimate for auch a bridge. The Board of Audit and Finance aay that when tho fiscal year ends, which will be la April, that they are illlng to conaiaer favorably and approve aay rtcommendatione which shall be made by the Board of Aldermen la reference to this bridge, aod that the expenses of its construction shall be then included in their estimate of ex peases of tbe city government for the current year. It ia forthese consid erations, the Solicitor ssys, that be haa thus far forborne to prosecute the case. And ia this, aa to ail other cases that he baa prosecuted ia the Court for. the paat tan years, ha la acting from -a sense of duty, and with a view to tbe heat Inter est of the public.
