Christian Reich bequeathed his home plantation of fifty, acres to his wife for life, and after her death one half to his daughter Uancy and the other half to Alfred Hampton and his wife Jureda and their children. There were seven of the children living at the time the testator died. Hampton and his wife sold one-half of the land, and now within twenty years the children make claim. Held, that under the proper con struction of the will, the seven chil dren of Alfred and Jureda were ten ants in common with their parents, each being entitled to one-ninth. Held, Possession by the defendants of seven years under color does not bar tenants in common, and that as tpntv wears had not elapsed, the rights of the plaintiffs are not barred . Covington vs. Newberger. One Davis being a drummer em ployed by defendant stopped at di vers times at the inn of the plaintiff, and ran up a bill. Plaintiff sued de fendant and seized on attaohment the sample cases of Davis, the property of the defendant, which the defend ant replevined. Held, That the implied authority of the agent to bind in the principal for necessary expenses in and about the agency docs not extend to making debts for board, that not being the general custom. Albert Metts, a colored man, aged about -24 years, was drowned Satnrday evening in a slough below the iron bridge, about a mile from town. Metts went to this place, to fish early Saturday evening and being subject to fits, it is sup posed that he was taken with one, fell into the water and was drowned. -New Bern Journal: The city taxes of Wilmington have been fixed for the ensuing year at two cents on the dollar's worth of realnd personal property.
