Int.feattoc Case at Durham Mr. Brook Ijospte a Party to ths Salt. The Durham Herald gives tbe follow ing particulars of a suit for tbe owner ship of a bird dog in which Mr. B. G. Empie. of Wilmington, was plaintiff: At Durham yesterday there was a suit for the ownership of a bird dog. Mr. B. G. Empie, a University law student, gave Mr. Oakev, of Durham, possession of the dog; tbe plaintiff regarding it as a tem porary loan, while tbe defendant consid ered it an absolute gift, with the condi tion that Empie could borrow him for banting purposes. Empie tried to get the dog. Oakey demurred to the complaint on the ground tbat a dog was not property and moved to dismiss tbe action, but this was over ruled. He then set np the claim that the dog wat bis rightful prop erty and fi'ed a counter claim for the training, care and board of tbe dog in tbe event tbe court should adjidge Em pie entitled to its pottettion. Tbe court found Empie was entitled to tbe dog. but tbat Oakey was enti led to $60 for care and board, to be off-set bv the smiunt of the earnings of tbe dog dun Lg two bunting seasons, which tas ascertained to be $50. Oakey ap pealed to tbe Superior Court, and gave bond for tbe possession of tbe dot? while the appeal is pending. Tbe Herald says that this is tbe first chapter in what is likely to prove North Carolina's most famous dog case.
