Brown, -Jr., rendered an exhauative opinion and findinga in favor of the plaintiffs in the case of Sute of North Carolina and County of New Hanover against the Armour Packing Company, which was' an ac tion to enforce the payment of corpor ation tax amounting to $1,000 e&chio the county and State for the year 1901 and 1903 under Section 91 of the Rivenue Bill, it being admitted that the corporation existing under . the law of the State of New Jersey, haa a capital atock of more than a million dollars. The constitutionality of the patiage of the act by the Legislature was call ed Into question by Hon. Jao. D. Bellamy, attorney for the defendant, while the plaintiff through Hon. George Bountree argued that there waa no aubttantial irregularity, aa finally held by Judge Brown. From the judgment of the court Mr. Bellamy appealed to the Supreme Court and it waa agreed that the judgment and findings of Judge Brown ahould con- etitute tbe case on appeal.
