The entire apportionment of legislative districts made by the last New York Legis lature is overthrown as unconstitu tional and void ,by the Court "of Ap peals in a decision handed down unex pectedly late today, the court. revers ing the judgments of the courts be low, which hitherto have sustained the act. . ....... .x. ; ; The decision does not effect the personnel or invalidate the acts of the present -Legislature, but - political relations andalignments in every rjart of the State made to suit the new con ditions have been thrown into confu sion. Formerly influential politicians who were supposed to have been kill ed politically by last;, year's - appor tionment, return to the field of influ ence. Far-seeing; politicians herevsay; that it is impossible to calculatethe consequences of Ihe decision . which' they describe as a "political -earthquake.'" It is generally believed here tonight that the decision . may pro long throughout May and,' perhaps in-' to June, the session of the Legisla ture because of the necessity of en acting a new apportionment,-the court holding that unless this is done the ext election for members of either house must be held under the appor tionment laid down in the constitution of 1895. which - the re-apportionment act of 1906 -was intended to supercede. City of Wilmington shall issue bonds for Water and Sewer age to the amount; of five hundred thousand dollar ( $ 500,000 ) and the levy and collection of the tax for the payment of such.. bonds and coupons. At said election, all qualified voters of the City cf Wilmington shall vote a ballot of white, paper, "three Inches long and two inches wide, upon which shall be written or printed the names of two electors from each of the five wards of the City of Wilmington to be voted for as members of the Board of Aldermen of said : city. And all qualified voters who favor the Issuance of bonds to the amount of four hun dred thousand dollars $(400,000) for Street Improvement, and the levy and collection of the tax for the payment of said bondsand coupons, shall vote a ballot of white paper, three inches long and two inches wide, '-with "For Street Improvement" written or print ed thereon; and: all qualified voters opposed thereto shall vote a ballot of similar size with "Against Street Im provement" written or printed thereon.
